OvERvIEwOn 29 June 2011, the Crown recognised the mandate oftheNgātiTaraTokanuinegotiatorstonegotiateacomprehensivesettlementofthehistoricalTreatyclaimsofNgātiTaraTokanuiwiththeCrown.ThemandatednegotiatorsandtheCrownenteredintoanagreementinprincipleequivalenton22July2011.On31May2017,NgātiTaraTokanuiandtheCrowninitialledaDeedofSettlement.
NgātiTaraTokanuiisamemberofthePareHaurakiCollectiveandwillalsoreceivecollectiveredressthroughthePareHaurakiCollectiveRedressDeedwhichwasapprovedinFebruaryandMarch2017.DetailsaboutthePareHaurakiCollectiveRedressDeedcanbeviewedontheNgātiTaraTokanuiwebsiteatwww.ngatitaratokanui.maori.nz.
TheratificationprocessoutlinedinthisbookletfocussesonNgātiTaraTokanui-specificnegotiations.

Crown acknowledgements and apology
TheDeedofSettlementcontainsacknowledgementsthathistoricalCrownactionsoromissionscausedprejudicetoNgātiTaraTokanuiorbreachedtheTreatyofWaitangianditsprinciples.
TheDeedofSettlementalsoincludesaCrownapologytoNgātiTaraTokanuiforitsactsandomissionswhichreacheditsobligationsundertheTreatyofWaitangiandforthedamagethoseactionscausedtoNgātiTaraTokanui.TheseincludethepromotionoflawsandpoliciesinNewZealandthatledtothealienationofNgātiTaraTokanuiland,causedenvironmentaldamagetotheWaihouandOhinemuriRivers,erodedNgātiTaraTokanuitribalstructuresanddislocatedthemfromtheirpāandkāinga.TheCrownfailedtoupholditsobligationsunderTeTiritioWaitangi/theTreatyofWaitangiandcausedphysicalandspiritualhardshipthatisdeeplyfeltbyNgātiTaraTokanuitoday.
Summary of the historical account
NgātiTaraandNgātiTokanuihaddistinctwhakapapabutwerejoinedovermanygenerationsthroughintermarriageandtogethercreatedtheiwiknowntodayasNgātiTaraTokanui.Duringthe19thcentury,NgātiTararangatiradescribedthemselvesprimarilyasNgātiKoi.
Between1865and1868,theCrownconfiscated290,000acresoflandaroundTauranga.Allcustomaryinterestsinthislandwereextinguished,althoughtheCrownreturnedmostofthedistricttootherMāori,andretained50,000acres.NgātiTaraTokanuihadinterestsinlandsthatwereincludedintheconfiscation.In1864theCrownpurchasedfromanotheriwisomeofthelandintheKatikatiandTePunablocks.NgātiKoilandswereincludedinthesetransactions.TheCrownacknowledged the interests of other iwi in subsequent negotiations,butNgātiKoihadnolandreturnedanddonotappear to have signed the sale deeds or to have been paid by theCrown.
InDecember1868,NgātiTaraTokanuirangatirawereamongthose who signed an agreement with the Crown to establish agoldfieldatOhinemuri.In1870NgātiTaraTokanuirangatiraTeKeepaRaharuhiappliedtotheNativeLandCourtforatitleinvestigationfortheOwharoainordertoallowgoldmining.TheCourtawardedOwharoatoNgātiTaraTokanui.
TheiwiaccumulateddebtsthroughtheNativeLandCourtprocess, and by 1875 six of Owharoa’s seven owners had sold theirintereststoprivatebuyers.Furthersalestookplaceinthe1880sand1890s.Today,justtwoacresofNgātiTaraTokanui’soriginalholdingsintheOwharoablocksremaininMāoriownership.
From1872,aCrownagentbeganmakingpre-titleadvancesto individuals he deemed to have interests in the Ohinemuri block.In1875,theCrownrealisedthatitwasnotgoingtobeable to obtain the agreement of enough owners to purchase theOhinemuriblock,anditnegotiatedaleaseinstead.Amongthe 88 individuals who signed the lease were at least eight membersoftheiwi.TheCrownappliedalltherentalincometo the repayment of advances despite not all of the owners havingacceptedtheseadvances.Asaresult,NgātiTaraTokanuididnotreceiveanyincomefromgoldminingintheirrohe.
Between1877and1882,aCrownofficialagainmadeadvancepayments to individuals he deemed to have interests in Ohinemuri.BecausetheCrownhadproclaimedmonopolypowersoverOhinemuri,Māorihadnooptionofalienatingtheirlandtoprivatepartiesiftheyneededtoselltheirland.In1882theNativeLandCourtawardedtheCrown31,714acresinOhinemuri17.Theremaining3,746-acreOhinemuri17Ablockwenttothenon-sellers(includingTeKeepa).Some1,170acresandthreewāhitapusiteswerereservedforNgātiKoi,halfthereservestheythoughttheyhadbeenpromised.AfterfurtherCrownpurchases,by1896NgātiTaraTokanuiwereleftwithapproximately2,500acresofland.
In 1895, the Crown authorised the discharge of mine tailings intotheWaihouandOhinemuriRivers,includingcyanide-treatedwaste.In1900aCrownofficialestimatedthatabout300MāoripeopleneededanalternativewatersupplybecausetheOhinemuririverwas‘polluted’and‘unfitforeitherhuman,oranimalconsumption’.
In1902,TeKeepaandotherMāoriprotestedthatthedischarge of mining waste into the rivers silted up the river beds,causingfloodingandextensivecropdamage.TheCrowneventuallyinitiatedanumberofschemestotryandcontroltheflooding,resultinginsignificantchangestotheWaihou and Ohinemuri Rivers and their tributaries and thesurroundinglandsfromwhichNgātiTaraTokanuihadtraditionallydrawnresources.
ThewetlandareasoftheHaurakiplainswereasignificantsourceoffoodandresourcesforNgātiTaraTokanui.Intheearly 1900s, the Crown established the Hauraki Plains drainage schemetodraintheswampanddevelopitforfarming.Theschemewasfurtherexpandedinthe1930s.From1978to1995,landwhichNgātiTaraTokanuihadtraditionallyoccupiedwastakenunderthePublicWorksActforworksrelatedtothedrainagescheme.Ofthe2,500acresNgātiTaraTokanuiretainedat1896,only232acresremainasMāorifreeholdlandtoday.

Cultural redressThisredressrecognisesthelossessufferedbyNgātiTaraTokanuiarisingfrombreachesbytheCrownofitsTreatyobligations.Theculturalredresspackagerecognisesthespiritual,cultural,ancestral,customary,traditionalandhistoricalassociationsofNgātiTaraTokanuiwithplacesandsitesownedbytheCrown.
Sites vested in Ngāti Tara Tokanui
SevensitesofculturalsignificancewillbevestedinfeesimpleinNgātiTaraTokanui:
• KepaPlace(0.23ha);
• NgāUreTara(0.44ha)
• MimituPā(180.48ha)subjecttoaconservationcovenant;
• TePouoTikiTeAroha(1.48ha)asascenicreserve;
• Tawhitiaraia(261ha)asascenicreserveandsubjecttoeasements;
• Ngāmarama(2.96ha)asarecreationreserve;and
• NgātiKoiDomain(54.13ha)asarecreationreserveandjointlyadministeredwiththeHaurakiDistrictCouncil.
Sites jointly vested in Ngāti Tara Tokanui and other iwi
ThefollowingsitesofculturalsignificancewillbevestedinfeesimpleinNgātiTaraTokanuiandotheriwiofHauraki:
• TannersPointproperty(0.20ha)willbejointlyvestedinNgātiTaraTokanuiandHako;and
• KarangahakeTihi(10ha)willbejointlyvestedinNgātiTaraTokanui,HakoandNgātiTamaterā,subjecttoaneasementandconservationcovenant.
Whenua rāhui
Anoverlayclassification(knownasWhenuaRāhui)willbeprovidedovertheKarangahakeScenicReserve.AWhenuaRāhuiacknowledgesthetraditional,cultural,spiritualandhistoricalassociationofNgātiTaraTokanuiwithcertainsitesofsignificance.ThedeclarationofanareaasanoverlayclassificationprovidesfortheCrowntoacknowledgeiwivaluesinrelationtothatarea.
Statutory acknowledgements
Theredresspackagewillincludetheprovisionofastatutoryacknowledgement over a range of sites and rivers and tributariesofsignificancetoNgātiTaraTokanui.AstatutoryacknowledgementrecognisestheassociationbetweenNgātiTaraTokanuiandaparticularsiteorareaandenhancestheiwi’sabilitytoparticipateinspecifiedresourcemanagementprocesses.
Statement of association with Moehau and Te Aroha
TheDeedofSettlementwillacknowledgethatNgātiTaraTokanuihasassociationswith,andassertscertainspiritual,cultural,historicalandtraditionalvaluesinrelationto,theMoehaumaungaandTeArohamaunga.
Protocols and relationship agreement
TheDeedofSettlementwillprovidefortheChiefExecutiveoftheMinistryforCultureandHeritageandtheMinisterforPrimary Industries to issue protocols that set out how their respectiveagencywillinteractwithandconsulttheNgātiTaraTokanuigovernanceentitywhencarryingoutstatutorydutiesandfunctions.
TheNgātiTaraTokanuigovernanceentitywillenterintoaconservationrelationshipagreementwiththeDepartmentofConservationthatwilloutlinehowtheDepartmentofConservationwillengagewithNgātiTaraTokanui.
Promotion of relationships
TheMinisterforTreatyofWaitangiNegotiationswillwritetoanumberoflocalauthorities,CrownagenciesandentitiestoraisetheprofileofNgātiTaraTokanui,advisethemofmattersofparticularimportancetotheiwiandprovideaplatformforbetterengagementwiththeiwi.
Cultural redress payment
TheCrownwillpaytheNgātiTaraTokanuigovernanceentitythefollowingamountsonsettlementdate:
• $100,000towardstheculturalrevitalisationofNgātiTaraTokanui;and
• $344,166toenablethepurchasebythegovernanceentityofthreepropertiesfromtheHaurakicollectivecommercialentity.
Vesting of minerals
IwiwilltakeownershipofanyCrown-ownedmineralsfoundinlandtransferredtothem.Thisdoesnotincludemineralscoveredbysection10oftheCrownMineralsAct1991(i.e.petroleum,gold,silveranduranium).
AlllandwhichiscurrentlysubjecttoSchedule4protectionwillcontinuetobesubjecttothesametypeofprotectiononceownedbyiwi.
Harbours and Hauraki Gulf
TheCrownandNgātiTaraTokanuihaveagreedtoconductseparatenegotiationsinthefuturetodiscusspotentialculturalredressinrelationtoTikapaMoana/theHaurakiGulfandTeTaiTamahine/TeTaiTamawahine.

Financial and commercial redressThisredressrecognisesthelossessufferedbyNgātiTaraTokanuiarisingfrombreachesbytheCrownofitsTreatyobligations.ThefinancialandcommercialredressisaimedatprovidingNgātiTaraTokanuiwithresourcestoassistthemtodeveloptheireconomicandsocialwell-being.
Thetotalvalueofthefinancialandcommercialredressinthissettlementis$6million.Thisincludes:
• $4.1millionalreadyreceivedinon-accountpayments;and
• thebalanceof$1.9milliontobetransferredonsettlementdate.
Thecommercialredressincludestherighttopurchase,fortwoyearsafterthesettlementdate,thePaeroaCollegeSchoolsite(landonly)subjecttoitslease-backtotheCrown.Intheeventthat the school site becomes surplus to Crown’s requirements, theCrownmaygivewrittennoticetothegovernanceentityadvising it that the school site is no longer available for selectionbythegovernanceentity.
