1. INTRODUCTIONThisStudentResidenceHandbookcomprisesofTermsandConditionsoftheResidenceContractbetweentheCollegeandtheResidentStudentwhomustsigntheResidenceContractFormandtherebyagreetobeboundbytheseTermsandConditions.TheTermsandConditionsoftheResidenceContractprovidemaximumfreedomlimitedonlybylawandthestandardsessentialtoharmoniousgrouplivingandtotheethosoftheCollege.

Thetermsandconditionslistedinthishandbookarenotexhaustive.

1.1 Resident AdvisorEachHallofResidenceisadministeredbyaResidentAdvisor(RA)whooccupiesanapartmentonthegroundfloor,neartheCommonRoom.TheRAisresponsibletothePresidentandtheSecretaryBursaroftheCollegeforthegoodconductandorderandharmoniousrunningoftheHallsofResidence.RA’s,beingthedulyauthorisedrepresentativesoftheCollege,mayexerciseauthorityintheHallsofResidence.

2. HALLS OF RESIDENCE

2.1 Residence ContractTheResidenceContractallowsaresidentstudenttheuseofanallocatedstudy-bedroomandincommonwithotherresidentstudentsoftheHallsofResidencetheuseofthekitchenettefacilities,bathroomfacilitiesandtheuseofothercommonareas.TheContractisenteredintowiththeresidentstudentwhosignsthecontractandtheroommaynotbeassigned,sub-contractedorotherwisedealtwithinwholeorinpartbytheresidentstudentwithoutobtainingthepriorwrittenconsentoftheCollege.ResidenceContractmustbereturnednolaterthanSeptember18th2015totheAdmissionsOfficeD118.

Theresidentstudentisresponsiblefortheconditionoftheirroomandforwhathappenstherein,fromthemomenttheyreceivetheirroomkeyuntiltheendoftheoccupancy.

2.2 Room Condition FormTheroomconditionformprovidedonarrivalistheofficialrecordofthecontentsandconditionoftheroomatthetimetheoccupiertakespossessionofit.Occupiersmustcheckthecontentsandconditionoftheroomandnoteanydiscrepancies/defectsontheformsatthecommencementofoccupation.Failuretodothismayresultintheoccupierbeingchargedwiththesedefects(ifany)onvacatingtheroom.TheformshouldbereturnednolaterthanWednesdaySeptember9th,2015totheAdmissionsOfficeD118.

2.3 Campus / Student ChargesPleaserefertoCollegeResidencessectionpage28intheStudentInformationHandbook2014.

2.5 Non-Resident StudentsForthepurposeoftheResidentContract“Non-resident”meansanystudentwhodoesnotresideintheHallsofResidenceandsuchnon-residentstudentcanonlyenjoythestatusofvisitor.

2.6 Check-inYoucheck-inontheappointeddayatthemainreceptionoftheCollegewhereyouwillcollectthekeytoyourallocatedroomoncampus–checkinSunday13thSeptember2015,timesforcollectionofroomkeywillbeoutlinedintheregistrationletterissuedwiththeregistrationpack.AlternativelyroomkeyscanbecollectedfromtheAdmissionsOfficeD118fromMonday14thSeptember2015.

2.7 Room AllocationYoucannotexchangetheroomallocatedtoyouforanother.TheCollegereservestherighttochangeyourroomallocatedatanytimeduringyourperiodofresidence.

2.8 Room UseStudentsmaynotoccupyorusetheroomortheresidencefacilitiesexceptduringtheperiodofeachcollegeacademicterm.TheCollegereservestherighttomakeuseofanyroomduringvacationperiods.Intheeventofsuchusetheresidentstudentmayberequiredtoremovehis/herpersonalbelongingsifsituationarises.

Studentsmaynotuseorpermittheroomtobeusedotherthanforapprovedresidentialandacademicpurposes(thisprohibits,interalia,useoftheroomoritsaddressforcommercialpurposesofanykind).

2.9 Residence CommitteeEachHallofResidencehasaResidenceCommittee,electedbyitsresidents,which,withtheResidentAdvisor,organisesandadministerstheactivitiesandfunctionsoftheresidence.TheResidenceCommittee,togetherwiththeRA,shallcompileandsignalistofthefurniture,fittingsandfurnishingsinthecommonareasandshallnoteanyexistingdamageinthoseareasatthebeginningoftheacademicyear.Thisagreedlistshallbeusedtodeterminedamagetoorlossofthelisteditems.

2.10 Student BehaviourStudentsareatalltimesexpectedto;

(1)Behaveinamannerwhichdoesnotdistress,embarrassorintimidatefellowresidentsand/orinterferewithotherpeople’srightsorproperty.

(2)BehaveinapeacefulandcivilfashioninyourinteractionwithfellowresidentsandvisitorstotheHallsofResidence,bothintheroomsandintheCollegeandsurroundingareas.

3. GENERAL INFORMATIONThere will be a general meeting for all Residential Students in the College Auditorium at 6.30 pm on Wednesday September 23rd, 2015. Attendance is mandatory for ALL Resident Students.

3.1 Bed linen and towelsYoumustprovideyourownbedlinenandtowelsi.e.sheets,pillows,pillowcases,underblankets,blankets/duvet,towelsetc.

3.2 LaundryYouareresponsibleforyourownlaundryarrangements.TherearenolaundryfacilitieswithintheCollege.Youarenotpermittedtoplaceanywashingintheroomsoranyotherpartoftheresidencecomplexandshallnotcarryoutanylaunderingorothersimilaractivitiesintheshowers,wash-handbasinsintheroomorintheresidence.

3.3 PostIncomingmailiscollectedeachdayatthemainReception/Porter’sDeskbyamemberoftheResidenceCommitteefordistribution.AllregisteredmailandparcelsmustbecollectedandsignedforpersonallyatthemainReception/Porter’sDesk.

3.4 SicknessAresidentstudentwhobecomesillandisconfinedtobed,shouldensurethattheRAisinformedassoonaspossible,eitherdirectlyorthroughtheResidenceCommittee,sothatappropriatearrangementsformedicalcare.StudentsshouldsupplytheRAwiththenamesandaddressesofnextofkinwhomaybecontactedintheeventofseriousillnessoremergencies.

3.5 AbsencesAbsencesfromCollegeshould,inthestudent’sowninterest,benotifiedinwritingtotheRAortheRegistrar’sAdministrationOfficeC103oremailregistrars.office@spd.dcu.ie.

4. RULES & REGULATIONS ON-CAMPUS

4.1 CookingEachHallofResidenceisequippedwithakitchenettefacilityforstudentsuse.Cookingisnotpermittedinthebedrooms,corridorsorareasotherthanwithinthekitchenette.Studentscaughtcookinganywhereotherthanthedesignatedkitchenettewillbefined€65forfirstoffenceand€150forsubsequentoffence.

ItisthestudentsresponsibilitytomaintainandkeepthekitchenetteandcookingequipmentinacleanandhygienicconditionandindemnifytheCollegeagainstclaimsarisingoutofafailuretoobserveduecareinthestorage,preparationandconsumptionofallfoods.Eachstudentshouldkeepallpersonalcrockery,cutleryandnon-perishablefoodintheirroom.

MealsareavailableintheCollegeDiningHall.

4.2 AlcoholStudentsmustnotbringin,keeporconsumealcoholicbeverage(s)orcausetobebroughtin,storedorconsumedalcoholicbeveragesintheroomorintheresidence.Breachesofthisruleshallmeritfinesand/orsanctionsandtheimmediateconfiscationanddisposalofthealcohol.Beingundertheinfluenceofalcoholwillnotbeacceptedasanexcusetoeitherexplainorjustifyirresponsiblebehaviour.

TheResidenceSecurityOfficermaydisposeofthealcoholbypouringthecontentsdownthesink,inthepresenceoftheresidentstudentorRAwhereappropriate.AlcoholwillbeconfiscatedbyCollegestaffasappropriate.(Afineof€65willbeleviedforbreachofthisregulation).

4.3 SmokingSmokingisnotpermittedwithintheCollegeResidences.(Afineof€65willbeleviedforbreachofthisregulation).

4.4 Electrical EquipmentYouarenotpermittedtoinstallanyadditionalelectricalequipmentincludingTV’s,DVDrecorders,(mini)fridges,portablecookers,electricalheaters,additionalelectricalwiring,gas-piping,orportablegasorparaffinheatersintheroomortheresidence.Ifanyadditionalelectricalappliancesarefoundtheyshallbeconfiscatedandreturnedtothestudentattheendoftheperiodofresidence.

4.5 Unlawful and Dangerous SubstancesStudentsmustnotstoreorkeeporpermittobekeptintheroomorinanypartoftheresidenceorofthecomplexanydangerous,combustibleorunlawfulsubstances.Studentsmustnotstoreoil,petrolorotherinflammablematerialswhatsoeverandmustreportimmediatelythepresenceofsuchsubstancesormaterialsleftbyanotherstudenttotheappropriatebody(TheCollegeoryourRA).

Studentsmustnotbringin,keeporuseorcausetobebroughtinkeptorusedintheroomorresidenceanydrugsorotherabusivesubstance(s).ThepenaltyforsuchaviolationshallbetheimmediaterevocationoftheResidenceContract.

4.6 VisitorsEverypersonotherthantheresidentsintheparticularresidenceisavisitorwhileinthatresidenceandaresubjecttotheauthorityoftheRA.Everypersonotherthanthepersonwhooccupiestheparticularroomisavisitorwhileinthatroom.AllvisitorsareexpectedtoabidebytheCollege’sregulations.Visitorsareadmittedontheclearunderstandingthattheywillnotcompromisethehealth,safety,securityandprivacyneedsofotherindividuals.Anyvisitormaybedeniedadmissionorremovedfromtheresidenceatanytime.Each student is responsible for the conduct of every visitor invited or permitted by them to be in their room of residence and is liable for any fines attaching to such conduct or presence.

Visitors are not permitted on the premises after 11.00 pm

No overnight visitors are permitted in the Halls of Residence

Intheinterestofthehealthandsafetyofallresidentstudents,itisvitalthatthisruleisnotcompromised.Breachofthisruleshallinvokeafirstoffencefineof€65.Asecondoffenceshallcarryafineof€150andathirdoffenceshallresultintherevocationoftheRoomContract.Thestudentshallberequiredtovacatetheirroominresidence.

4.7 Decorations and Residence AppearanceStudentsmustnothangorexhibit,exceptinanapprovedmanner,anysignboard,decorations,postersoradvertisingmatter,oranyplacard,flagorbannerinoronaroom,residenceorcomplex.Decorationsmustnotimpedeorhinderoccupants’accesstoexits.Firefightingequipmentoralarmsmustnotbecoveredwithanydecorativematerials.Intheinterestsofhealthandsafety,noopenflamesofanykindorsmokeproducingmaterialorcandlesofanysort/descriptionmaybeusedforlightingeffectincorridorsorrooms.Costsincurredtocleanoffdecorationsinthe

roomorintheresidenceshallbedeductedfromtheDamage/DisciplinaryDepositonanindividualbasisorprorataasappropriate.Chargesshallbeassessedonthestudent’saccountwheneverdamagetotheroomoccursduetotheuseoftape,adhesive,pictureholders,thumbtacks,nailsdecals,blue-tacketc.

5. SECURITY

5.1 Campus SecurityEachResidenceisprivatetotheresidentstudentinit.YourroomisprivatetoyourselfandmayonlybeenteredwithyourpermissionbyauthorisedCollegeStaffintheperformanceoftheirduties.Roomsshouldbelockedwhenunoccupiedorwhenresidentsareasleepintheirrooms.

TheCollegeprovidesoncampussecurity24hoursperday,365daysayear.Securitycanbecontactedontelephonenumber(01)8842299/byinternaltelephonenumber2299orbymobilenumber0871344132.ThesecuritybaseislocatedatthesideofMovilleHouse.

Inadditiontothemainsitesecurity,adedicatedsecurityofficerisprovidedfortheHallsofResidence.TheResidenceSecurityOfficercanbecontactedontelephonenumber(01)8842334/byinternaltelephonenumber2334orbymobilenumber0877383944.

5.2 Campus Room KeysStudentsshouldnotunderanycircumstancespartwiththepossessionofthekeystotheroomortheproximitycardandshallreportanylossthereofimmediatelytotheRAandshallindemnifytheCollegeinrespectofanyreplacementofkeysand/orlocksarisingtherefrom.

RequestsforreplacementoflostkeysmayonlybemadetotheHeadPorter,MrPaulWhelan.Akeyreplacementfeeof€20willapplyduringtermtime.

Failuretoreturnaroomkeymayrequirethereplacementofthedoorlock.Aseparatechargeof€150toreplaceadoorlockwillapply.

5.3 Proximity CardsEntrancetotheHallsofResidenceisbyproximitycardonly.EachResidentstudentisissuedandisrequiredtoretaintheirproximitycardcarefullyontheirperson.Intheeventofthecardbeinglostormislaid,reportthisimmediatelytoCollegesecurity,andareplacementProximityCardwillbearrangedandafeeof€15willapplywhilethelostcardisdeactivated.ThroughtheexerciseofnormalcareandvigilancestudentsshouldexercisearesponsibilityforthesecurityoftheHallsofResidence.

5.4 IdentificationIntheinterestofthehealth,safetyandsecurityofallCollegestudents,astudentmustcarrytheirCollegeIDatalltimesandproducetheirCollegeIDcardifrequestedbyanymemberoftheCollegeStaffandortheCollegeSecurityStaff.FailuretocarryandproduceaCollegeIDCardonrequestisaseriousbreachoftheResidenceContractandmaybedeemedasarevocationofthesaidcontract.RevocationoftheResidenceContractshallresultinthestudentvacatingtheirroominresidence.

5.5 Safety and Security of PersonsToendangerthehealth,safetyorsecurityofanymemberoftheHallsofResidenceorthesecurityoftheHallsofResidenceitselfisaseriousbreachoftheResidenceContractandtheCollegereservestherighttorevokeitpartiallyorcompletely.

Residentsandtheirvisitorsmustenteronlyviathefrontormainentranceandmustnotjumporclimbgates/fencesorwalls.Windowsarenottobeusedforaccess/egress.IntheinterestsofsafetythedoorsoftheHallsofResidencemustnotbeleftopenatanytime.Todeliberatelyarrangetohaveanexitdoorremainopenisanoffenceandsubjecttoafine.Yourroomdoorshouldalwaysbelockedwhenleavingtheroom.Breacheswillbesubjecttoafineof€100foreachandeveryinstance.

6. MAINTENANCE

6.1 Room and Residence MaintenanceStudents must:

•Keepallfurniture,fixtures,fittingsappliancesandarticlesintheroomandresidenceingoodandproperrepairandpaytotheCollegeanamountequivalenttothereplacementcostofsuchitemsasmaybebrokenordestroyedduringthecurrencyofthisContactandshallindemnifytheCollegeagainstallclaimsarisingoutofanddamagethereto.

•ReportalldamageandmaintenancerequirementsimmediatelyinwritingtotheRAwhointurnwillreporttotheBuildingsMaintenanceOfficer.

•Notdamageorremoveorpermittobedamagedorremovedthefurniture,fixturesandfittings,appliancesorarticlesfromtheroomortheresidence.

•Notundertakeanycookingexceptinthekitchenetteintheresidenceandshallnotdisposeofanymaterialsintoanysinkorlavatoryorotherwisesoastoblockanydrains,pipesorsewersservingtheresidenceorthecomplex.

•Notplaceanybottles,containersorotherarticlesintheareaofthewindowsintheroomortheresidence.

•Notplaceorcauseanyobstructionintheentrancestotheresidenceandinparticularshallnotplaceanyvehicles,motorcyclesorbicyclestherein.

•Notkeepanyanimalwhetherasapetorotherwiseintheroomortheresidenceorthecomplex.

•NotimpedetheCollegeagentsorstaffenteringtheroomortheresidenceforthepurposeofexaminingthestateofrepairandconditionthereoforforthepurposeofeffectingsuchrepairsorrenovationstotheroom,theresidenceoranypartofthecomplex.

There will be an inspection of each room at least once a term by authorised College personnel. Such inspections do not require notification.

6.2 Room CleaningStudentsmustkeeptheinterioroftheroomandresidenceinacleanandhygieniccondition,includingallfixtures,fittingsandinstallations,andalldrainsandsanitaryfittingsthereinandshallindemnifytheCollegeagainstallclaimsarisingoutofanydamagethereto.

Theroommustbemadeavailableforcleaning,ifnecessary,between9.00amand1.30pmeachdayfromMondaythroughFriday.

6.3 Electrical Equipment and SafetyEachstudentshallassumefullresponsibilityfortheirownsafetyandthesafetyofanyvisitorintheirroomorresidencewhenpersonalelectricalequipmentispluggedintotheCollege’selectricalsupply.Electricalequipmentmustnotbeusedunlessallstandardsafetyregulationsareobserved.

10. TERMS & CONDITIONS

10.1 Discipline – Resident StudentsFinesandsanctionsforbreachesofthetermsandconditionsoftheResidenceContractshallbeimposedbytheRAandortheSecretary/BursarasspecifiedinthisHandbookortheseparatelistsuppliedtoeachresidentstudent.OtherfinesandsanctionsmaybeimposedbytheRAortheSecretary/Bursar,ascircumstancesrequire,afterconsultationwiththePresident.

WhenintheopinionoftheSecretary/Bursarastudenthasbreachedthecontracthemayremovethestudentfromtheresidenceormayapplyalessersanctionsuchasaroomchange,fineorprobation.AbreachofcontractcaseisnotsubjecttotheCollege’sCodeofDisciplineandwillnotbeacceptedforhearingbyaDisciplinaryCommitteeunlessadditionaldisciplinaryaction,suchasprobation,suspensionorexclusionfromtheCollege,appearswarranted.

TheSecretary/Bursarmayactadministrativelytomaintaintheresidencehall,livingandlearningenvironmentbymovingastudenttoaroomotherthantheonetowhichhe/shewasinitiallyassignedor,whenrequiredinthebestinterestsoftheCollegeasdeterminedbytheSecretary/Bursar,byremovingastudentfromCollegeresidence.AdministrativeactiontakeninaccordancewiththisregulationisnotadeterminationoftheSecretary/Bursaronthemeritsofanyunderlyingdisciplinarychargefiledbyoragainsttheaffectedstudent(s).

ThedecisionoftheSecretary/BursarinrespectoftheabovetwoparagraphsmaybeappealedtothePresidentwithin3workingdaysofthedecisionbeingcommunicatedtothestudent.ThePresidentmayassignthecasetoanominatedpersontodealwithonhisbehalf.ThePresident’sdecisionisfinal.

10.2 Damage/Disciplinary DepositTheDamage/DisciplinarydepositisretainedbytheCollegeasanindemnityagainststudentliabilitytotheCollege.ThisdepositisrefundableinwholeorinpartonlywhentheCollegehasascertainedthatnooutstandingliabilitiesremaintobepaid.

• Refunds will be electronically transferred once processed.

Eachstudentwillbeheldresponsibleforanydamagetofurnitureorfittingsintheirrespectiveroomsandmustrecoupanyfinesleviedfromotherswhomightbeinvolved.Anydamagetoastudent’sroomorcommonareashallbechargedtotheoffenders.If offenders cannot be identified, after reasonable enquiries, fines may be levied pro rata on students resident on a corridor, or on that side of the Residence, or in the entire Residence.

Thedamageresidential/disciplinarydepositforeachresidentis€400whichincludesa€200depositfortheresident’sroom[“individualdeposit”]and€200depositinrelationtothecommonareasofthehallofresidence[“communitydeposit”].

Theindividualdepositandcommunitydepositmaybeforfeitediftheroom/commonareaisdamaged.

WherearesidenthasbeendisciplinedinrelationtodamagetocollegepropertyorhaspaidfordamagetocollegepropertytheCollegewillincreasethedamageresidential/disciplinarydepositforthatresidentto€800withimmediateeffect.Failure to pay the additional deposit will result in revocation of this contract.

10.3 Damage/Disciplinary FinesWherebreachesoftheTermsandConditionsoftheResidenceContractoccurfinesshallbeleviedonthestudentinwhoseroomsuchbreachesoccur.Ifvisitorsareinvolvedafineshallbeleviedinrespectofeachvisitor(4.6Visitors)andthestudentisresponsibleforrecoupingfromthevisitorstheamountofthefinesimposed.Thisprocedurewillalsoapplytofinesincurredbyvisitorsintheresidence.Wheremorethanonestudentisresponsibleforvisitors,fineswillbeleviedaccordingly.Finesincurredbyyouduringyourperiodofresidencemustbepaidwithin14daysoftheissuedateofthefineseparatelyanddirectlytotheFinanceOffice(officeC102).Theconsequencesofsuchfinescanbeveryseriousandmustbecarefullynotedbyeachresidentstudent(seesection10.1and10.2).ThefinesattachingtobreachesoftheTermsandConditionsareshownonaseparatelist(Section14)andmaybechangedasconditionswarrant.

Thissectionshallbeappliedwithparticulareffectwhere‘watershowing’occursorwheresnowormudisinvolved.Residents’attentionisdrawntotheliabilityoffinesbeingleviedduringRagWeekonallorsomeresidentsformisbehaviourbyindividualswhocannotbeidentifiedafterreasonableenquiries.

10.4 Inappropriate ConductStudentsmustnotthrowordeposit,orpermittobethrownordepositeddirt,rubbish,ragsorotherrefuseintheroom,theresidenceorthecomplexandatalltimesshallmakesureofthecommonrubbishbininrespectofsuchitemsforremovalbytheCollege.

Studentsmustnotthrowwateroranyotherliquidorobjectinorfromtheroomortheresidence.IfsuchactivityresultsindamagetoorworsenstheconditionofthepremisesorinvolvesextralabourandcostsbystafftheRAand/ortheSecretary/Bursarmaylevyafineonallorsomeresidentsifreasonableenquiriesfailtoidentifythoseresponsible.Suchfinescanberecoupedfromthoseresponsible.

Studentsmustnotundertakeanycookingexceptinthekitchenetteintheresidenceandshallnotdisposeofanymaterialsintoanysinkorlavatoryorotherwisesoastoblockanydrains,pipesorsewersservingtheresidenceorthecomplex.Studentscaughtcookinganywhereotherthanthedesignatedkitchenettewillbefined€65forfirstoffenceand€150forsecondoffence.

WheretheserequirementsareclearlydisregardedandposehousekeepingproblemstheRAand/ortheSecretary/Bursarmaylevyafineprorataorimposesanctionsonallorsomeresidentsifreasonableenquiriesfailtoidentifythoseresponsible.Therecoupmentofmoniesforaproratafinefromtheguiltypartiesshallbetheresponsibilityofthosefined.Collegestaffarenotobligedtowashupanyutensils,crockeryorcutleryusedbystudents.

Studentsmustnotholdpartiesand,inparticular,notbeinvolvedinanydangeroushorseplay,gamesordiversionsintheroom,residenceorcomplexandshallnotplaymusicalinstrumentsorradios,televisionsorothersoundproducingapparatusnorengageinshoutingorloudconversationsorsinginginsuchmannerastocausedistractionornuisancetootherresidentstudentsandinparticularnotbetweenthehoursof11.00pmand7.00am.Finesshallbeleviedforsuchbreachesandifvisitorsareinvolvedthestudent(s)shallberesponsibleforrecoupingit.

Nopartiesorplayingofmusicalinstrumentsorradiosorothersound-producingapparatusinsuchmannerastocausedistractionornuisancetootherresidentsatanytimeispermitted.A“nonoise”policyisinplacebetween11.00pmand7.00am.Noiseisconsideredanuisancewhensoundcanbeclearlyheardoutsidetheroom.WhereSecuritybreakupagathering,residentsmustreturntotheirownroomimmediatelyontheirinstruction.Afineof€50willbeimposedfornoiseandafineof€100forpartiesforeachandeveryinstance.

10.5 Rights of the CollegeTheCollegemayrepossess,reassignorinspectroomsfor:

a)BreachesofthetermsandconditionsoftheResidenceContract;

b)Healthandsafetyandorsocialreasons;

c)Inabilitytoobservereasonablestandardsofbehaviourexpectedinacommunitysetting;

d)SuspectedviolationsofStateandLocalGovernmentlawsandregulations;

e)AnyconductprejudicialtothebestinterestsandethosoftheCollege.

10.6 Privacy and FreedomStudentsmustnotinterferewiththerightofotherstoprivacyandfreedomtoenjoyundisturbedstudy,restandsleepespeciallyduringtheperiodsofExaminationsandSchoolPlacement.Afineof€65willbeimposedonoffendersforeachandeveryinstance.

10.7 Additional Terms and ConditionsTheSecretary/BursarandtheRAbeingthedulyauthorisedRepresentativesoftheCollegearechargedwiththeorderlyandharmoniousadministrationoftheresidence.FromtimetotimeadditionaloralternativeTermsandConditionsmaybeconsiderednecessaryandtheseshallbecomeintegralpartsoftheResidenceContractafterapprovalbythePresident.Alloranysuchadditionaltermsandconditionsshallbenotifiedtoresidentsbypostingatypedcopyofsameonthenotice-boardintheresidenceandsuchpostingoraffixingshallbedeemedtoconstitutedueandpropernoticeofsame.

11. FIRE & EMERGENCYIn accordance with the Terms and Conditions of the Residence Contract each Resident Student shall:

•BeboundbyallFireSafetyRegulationsandmustobeythemtoinsuretheSafetyofallpersonsintheresidence.Responsibilityfornon-compliancecanleaveapersonliabletocriminalprosecution.

•Notinterferewith,removeorrelocate,orrenderinoperableoruselessafirealarm,afireexitdoor,afireextinguisher/s,akeyboxoranyfirefightingequipmentorfirstaidboxoranyassociatedsafetyequipment.

•PaytheactualexpensesincurredbyanyattendingFireBrigade(s)Unit,AlarmServiceCompanyorotherspecialistpersonnel,duetosettingoffafalsealarmortocausingafire.WheretheoffendingpersonrefusestoacceptresponsibilityorcannotbeidentifiedafterreasonableenquiriesthecostsofanyattendingFireBrigade(s)Unit,AlarmServicesCompanyorotherspecialistpersonnelshallbeleviedprorataontheresidentsoftheresidence(s)affected.

•TakeallreasonablestepstoensurethatanybreachoftheFireSafetyRegulationsarebroughttotheimmediateattentionoftheRAandappropriateCollegepersonnel.

•CooperatefullywithfiredrillswhichshallbeorganisedinconsultationwiththeRAanddischargesatisfactorilyanytaskswhichsuchdrillsmayrequire.Failuretoevacuatewillautomaticallyincurafineof€25foreachandeveryinstance.

WithoutprejudicetotherightoftheCollegetosuspendorexpelastudent,ortopartiallyorabsolutelyrevoketheRoomContract,afirstoffenceshallincuranautomaticfineof€300andasecondoffenceshallincuranautomaticfineof€600.Ineachinstancetheoffendingstudentshallalsopaythecostofanyrefillorrepairsorcleaningarisingtherefrom.

KindlyrefertotheFireServicesAct1981.Penaltiesincludebotha€634fineandasixmonthjailsentenceatthediscretionofthecourt.

12. ENDING RESIDENCE

12.1 Return of RoomThestudentshallleavetheroominacleanandorderlyconditionandremoveallpersonaleffectsandbelongingstherefromnotlaterthan6.00pmonthedayofdeparture.Anysuchpersonaleffectsorbelongingssoleftintheroom,orintheresidenceafterthattimeshallbedisposedofbytheCollegeatitsdiscretionwithoutincurringanyliabilitytotheresidentstudent.IntheeventoftheCollegerequiringtheservicesofanexternalcontractcleaningcompanytocleanastudentroom,thecostsassociatedwiththisactivityshallbedeemedpayablebytheresidentstudent.

12.2 Return of KeysYoumustreturnyourkeystotheAdmissionsOfficeD118duringofficehoursortothemainReception/Porter’sDesk/CollegeSecuritywhendepartingforthesummerholidaysorifrequiredtodosoatothertimes.Failuretocomplymayresultinachargebeingleviedforthepriceofanewkey,areplacementdoorlockandanyattendantfittingcharges.

12.3 Refund DepositAttheendofthelastperiodofresidencetheroomdepositoranybalanceremainingshallberefundedlessanydebtsduetotheCollege.RefundswillbepostedtohomeaddressinAugust2015.

12.4 ReferenceAreferenceforfuturelandlordsmaybeprovidedbytheAccommodationOfficertostudentswhohavenofines,penaltiesordisciplinaryfinesissuedagainstthemduringtheirperiodon-campus.

13. ADDITIONAL INFORMATION

13.1 Vacating of Room for College PurposesIftheCollegerequirestheresidentstudenttovacatetheroomduringthetermofthisContract,byvirtueofnecessaryalteration,repairsordecorationhavingtobecarriedouttotheroom,theresidenceorthecomplexorbyvirtueofsuchothercircumstancesastheCollegemayreasonablyconsiderrequiresvacationoftheroom,theresidentstudentshallvacatetheroomwithinandforsuchperiodastheCollegemaystipulateprovidedthatalternativeaccommodationismadeavailabletotheresidentstudent.TheCollegeshallnotbeliableforanyloss,costorexpensesufferedbytheresidentstudentbyreasonofvacationoftheroominaccordancewiththisclause.

13.2 Vacation PeriodPriortothestudentvacatingtheresidenceatChristmasandEastervacation,thestudentshallleavetheroominacleanandorderlyconditionandstoreawayallpersonaleffectsandbelongings/equipmentinthewardrobe.Pleasevacatenotlaterthan6.00pmonthedayofdeparture.

13.3 Revocation of ContractTheResidenceContractshallbeabsolutelyrevokedforthwithinthecaseofaResidentStudentwhoischargedwithandconvictedofanindictableoffenceandsuchstudentshallvacatetheroomandtheresidenceon14day’snoticeinwriting,withoutprejudicetoanyotherrightsaccruinginfavouroftheCollegeunderthetermsandconditionsoftheResidenceContract.

IntheeventofaseriousbreachofanyofthetermsorconditionsoftheResidenceContractthentheCollegemayatitssolediscretionrevokeforthwiththisResidenceContractandtheResidentStudentshallvacatethepremiseson14days’noticewithoutprejudicetoanyotherrightsaccruinginfavouroftheCollegeunderthetermsandconditionsoftheResidenceContract.
