A. Introduction1. Floridahasatotalof248delegatesand18alternatesforthe2020Democratic

NationalConventioninMilwaukee,WI.(CallI&AppendixB)2. ThedelegateselectionprocessisgovernedbytheCharterandBylawsofthe

DemocraticPartyoftheUnitedStates,theDelegateSelectionRulesforthe2020DemocraticNationalConvention(“Rules”),theCallforthe2020DemocraticNationalConvention(“Call”),theRegulationsoftheRulesandBylawsCommitteeforthe2020DemocraticNationalConvention(“Regs.”),therulesoftheDemocraticPartyofFlorida,theFloridaelectioncode,andthisDelegateSelectionPlan.(CallII.A)

3. FollowingtheadoptionofthisDelegateSelectionPlanbytheStateParty’sExecutiveCommittee,itshallbesubmittedforreviewandapprovalbytheDNCRulesandBylawsCommittee(“RBC”).TheStatePartyChairshallbeempoweredtomakeanytechnicalrevisionstothisdocumentasrequiredbytheRBCtocorrectanyomissionsand/ordeficienciesasfoundbytheRBCtoensureitsfullcompliancewithPartyRules.SuchcorrectionsshallbemadebytheStatePartyChairandthePlanresubmittedtotheRBCwithin30daysofreceiptofnoticeoftheRBC’sfindings.(Reg.2.5,Reg.2.6&Reg.2.7)

4. OncethisPlanhasbeenfoundinCompliancebytheRBC,anyamendmenttothePlanbytheStatePartywillbesubmittedtoandapprovedbytheRBCbeforeitbecomeseffective.(Reg.2.9)

B. DescriptionofDelegateSelectionProcess1. Floridawilluseaproportionalrepresentationsystembasedontheresultsofthe

2020PresidentialPreferencePrimary,heldonTuesday,March17,2020forapportioningdelegatestothe2020DemocraticNationalConvention.

2. The“firstdeterminingstep”ofFlorida’sdelegateselectionprocesswilloccuronTuesdayMarch17,2020,withastate-runPresidentialPreferencePrimary.

C. VoterParticipation

1. Participationinthestate’sdelegateselectionprocessisopentoallvoterswhowishto

participateasDemocrats.(Rule2.AandRule2.C.)a. ToparticipateintheFloridaPresidentialPreferencePrimary,votersmustbe

registeredtovoteinFloridaasaDemocrat30dayspriortotheelection,beingFebruary18,2020.(Rule2.A&Reg.4.3.A)

b. UnderFloridalaw,voterswhoarecurrentlyregisteredwithanotherpartyorwithnopartycanchangetheirpartyaffiliationtoDemocratinFloridanolaterthan30dayspriortothePresidentialPreferencePrimary,beingFebruary18,2020.(Rule2.A&Reg.4.3.A)

c. UnderFloridalaw,votersmustbe18asofthedateoftheprimarytobeeligibletoparticipate.Voterswhowillbe18bythedateoftheGeneralElectionbutnotbythedateoftheprimarywillnotbeallowedtoparticipate.

d. AtnostageofFlorida’sdelegateselectionprocessshallanypersonberequired,directlyorindirectly,topayacostorfeeasaconditionforparticipating.VoluntarycontributionstothePartymaybemade,butundernocircumstancesshallacontributionbemandatoryforparticipation.(Rule2.D&Reg.4.4)

e. NopersonshallparticipateorvoteinthenominatingprocessfortheDemocraticpresidentialcandidatewhoalsoparticipatesinthenominatingprocessofanyotherpartyforthecorrespondingelections.(Rule2.E)

f. Votesshallnotbetakenbysecretballotatanystageofthedelegateselectionprocess,includingprocessesleadinguptotheselectionofDNCMembersorStateChairsorViceChairs,whoserveasDNCmembersbyvirtueoftheiroffice,exceptthatuseofsuchvotingbysecretballotmaybeusedinaprocessthatisthefirstdeterminingstageofthedelegateelectionprocessandinwhichallindividualvoterswhowishtoparticipateasDemocratsareeligibletodoso.(Rule2.F)

g. Nopersonshallvoteinmorethanone(1)meetingwhichisthefirstmeetinginthedelegateselectionprocess.(Rule3.E&Reg.4.7)

2. Florida’sPresidentialPrimarywillberunbytheFloridaDivisionofElections.TheFloridaDemocraticPartyworkswiththeDivisiontoensurethatelectionsarerunopenlyandfairly.Inthatregard,theFloridaDivisionofElectionshassetupasystemto:

a. Maintainsecureandaccuratestatevoterregistrationrolls,sothateveryeligible

Americanwhoregisterstovotehastheirpersonalinformationprotectedandsecure;(Rule2.H.1)

b. Implementtransparentandaccuratevoterregistrationlistmaintenanceproceduresthatcomplywithfederalrequirementsandensurethateveryeligiblevoterstaysontherolls;(Rule2.H.2)

c. Promotetheacquisition,maintenance,andregularreplacementofprecinctbasedopticalscanvotingsystems;(Rule2.H.3)

d. Ensurethatanydirectrecordingelectronicsystemsinplacehaveavoterverifiedpaperrecord;(Rule2.H.4)

e. Implementrisklimitingpost-electionauditssuchasmanualauditscomparingpaperrecordstoelectronicrecords;(Rule2.H.5)

f. Ensurethatallvotingsystemshaverecognizedsecuritymeasures;(Rule2.H.6)g. Useaccessibleandsecurevotingmachinesthatmakeitpossibleforindividuals

withdisabilitiestovotesecurelyandprivately.(Rule2.H.7)

3. InaccordancewiththeDemocraticParty’srequirementtoassessandimproveparticipationwithrespecttopresidentialpreferenceandthedelegateselectionprocess,TheFloridaDemocraticPartyiscommittedtoincreasingvoterparticipation.

a. ParticipantsintheFloridaDemocraticPresidentialPrimarywillhavethree

optionstovote:1. VotebyMail–Votebymailballotsaremailedtovoterswhohave

notifiedtheirlocalcountyelectioncommissionoftheirdesiretovotebymail30dayspriortotheelection.TheFloridaDemocraticPartyisworkingwithlocalcountyelectionofficialsandCountyCommissionstoallowvoterstoreturnballotspostagefreeandhavemetwithsomesuccessonthatrequest.Also,asaresultoflitigation,theFloridarequirementofanexactsignaturematchonmailinballotshasbeenstruckdown.

2. EarlyVote–CurrentFloridalawrequiresthateachcountyallownomorethan20andnolessthan10daysofearlyvotinginacounty.Thedecisionofhowmanydaysofearlyvotingandthelocationofearlyvotinglocationsareleftuptothecountyelectionofficer.TheFloridaDemocraticPartyworksaggressivelytopushthoseelectionofficerstochoosethemaximumnumberofdaysandthelargestnumberoflocationspossible.In2018,asaresultofalawsuit,thelawagainstusingcollegecampusesasearlyvotinglocationswasstruckdownandthroughtheeffortsoftheFloridaDemocraticParty,multiplecountiesforthefirsttimehadearlyvotingsitesoncollegecampuses.

3. ElectionDayVoting–Thesearethetraditionalvotingsitesaresetupineachprecinct.

4. Weworktoensurethatvotinglocationsareaccessible,fairlyplaced,andadequateinnumber,andhaveasufficientnumberofvotingmachines;In2018,throughcourtaction,thebanonFloridahavingearlyvotinglocationsoncollegecampuseswasstruckdown.Thisresultedinearlyvotingsitestobeoncollegecampusesinmostofthelargercountiesforthefirsttimeinthe2018GeneralElection.(Rule2.I.1.b)

b. Toimproveparticipationbyouryoungregistereddemocrats,theFloridaDemocraticPartywillallowindividualswhowillbe18yearsofagebyelectiondaytorunasadistrictleveldelegateandvoteintheCongressionalDistrictcaucuses.

4. Wehaveinthepastandwillcontinuetohelpcountyelectionofficersrecruitsearly

voteandelectiondayworkerstospeedupthevotingprocessandminimizelonglines.(Rule2.I.1.c)a. Wehaveworkedbothlegislativelyandthroughthecourtstoeliminateonerous

anddiscriminatoryvoteridentificationrequirements;Inthisregard,throughcourtaction,therequirementofasignaturematchonvotebymailballotswasdeclaredinvalidinFebruaryof2019.Whilethecourtrulingissubjecttoappeal,

itisourhopethatthisrequirementwillnolongerbeusedinthe2020Election.Rule2.I.1.d)

b. Thepastlegislativeefforts,processestocountandincludeinthefinaltotalballotsfromvoterswhoareeligibletovotebutcasttheirballotsinthewrongprecinct,forofficesforwhichtheyareeligibletovote.(Rule2.I.1.e)

5. Wehaveworkedtoincreasevoterregistrationandfacilitatemilitaryandoverseas

voting.(Rule2.I.1.f)

6. Aspartofencouragingparticipationinthedelegateselectionprocessbyregisteredvoters,theFloridaDemocraticPartyiscommittedtoandworkingtoimplement:(Rule2.I.2)

a. Voterregistrationmodernization,includingonlinevoterregistrationandautomaticandsame-dayregistration.ItshouldbenotedthatFloridain2018decidedtoallowonlinevoterregistration.Also,legislationwasproposedbyDemocratsinthe2019LegislativesessiontorequireFloridatoregisteritscitizenstovoteautomatically.Thislegislationispending.(Rule2.I.2.a,d)

b. CurrentlyFloridalawallowspeopletopre-registertovotebeginningatage16.(Rule2.I.2.b)

c. Floridavoterspassedaconstitutionalamendmentin2018restoringthevotingrightsoffelonswhohaveservedtheirsentence,exceptforthoseconvictedofmurderandcertainsexcrimes.Florida’sGOPcontrolledlegislatureisnowtryingtominimizetheimpactoftheamendmentbyproposingimplementinglegislationtomorebroadlydefinethedefinitionofthecrimesandmorenarrowlydefinewhatconstitutesashave“served”theirsentence,includingrequiringavarietyoffeesandcoststobepaid.Florida’sDemocraticlegislatorsareresistingthoseefforts.(Rule2.I.2.c)

7. Floridahasastate-runPresidentialPreferencePrimary.VotersinFloridacanchangetheirpartyregistrationupto30dayspriortotheelection.(Rule2.JandRule2.J.1)

8. SchedulingofDelegateSelectionMeetingsa. Thedates,timesandplacesforallofficialsDemocraticPartymeetingsand

eventsrelatedtothestate’sdelegateselectionprocessmustbescheduledtoencouragetheparticipationofallDemocrats.Suchmeetingsmustbeginandendatareasonabletime.(Rule3.A&Reg4)

SectionII

PresidentialCandidates

A. BallotAccessApresidentialcandidategainsaccesstotheFloridapresidentialpreferenceprimaryballotbythefollowingprocedure:

1. TheFloridaDemocraticPartywillprepareandapprovealistofrecognizedDemocraticpresidentialcandidates.ByNovember30,2019,theFloridaDemocraticPartywillsubmitalistofitspresidentialcandidatestotheSecretaryofStatetobeplacedonthePresidentialPreferencePrimaryballot.ThisdateisdeterminedtheFloridaSecretaryofState,pursuittoFloridaStatelaw.

2. TheSecretaryofStateshallprepareandpublishalistofnamesofthepresidentialcandidatessubmittednolaterthanDecember3,2019.

3. TheDepartmentofStateshallimmediatelynotifyeachpresidentialcandidatelistedbytheSecretaryofState.Suchnotificationshallbeinwriting,byregisteredmail,withreturnreceiptrequested.

4. OntheFloridaPresidentialPrimaryballot,itdoesnotlist“uncommitted”apresidentialoption.

5. WriteincandidatesareallowedontheFloridaPresidentialPrimaryballot.WriteincandidatesmustfilewiththeSecretaryofStatebeforetheelection.

6. Thereisnootherprocedure(i.e.,filingprocess)bywhichpresidentialcandidatesgainaccesstotheFloridaPresidentialPreferencePrimaryballot.

B. OtherRequirements

1. EachpresidentialcandidateshallcertifyinwritingtotheStateDemocraticChair,thename(s)ofhisorherauthorizedrepresentative(s)byMonday,December2,2019.IndividualswhoannouncetheircandidacyafterthisdatemustprovidethisinformationtotheChairoftheFloridaDemocraticPartynotlaterthanten(10)daysaftertheirannouncement.(Rule13.D.1)

2. EachpresidentialcandidateshallusehisorherbesteffortstoensurethathisorherrespectivedelegationwithinthestatedelegationachievestheaffirmativeactiongoalsestablishedbythisPlanandisequallydividedbetweenmenandwomen.(Rule6.I)

SectionIII

SelectionofDelegatesandAlternates

A. District-LevelDelegatesandAlternates

1. Floridaisallocated143district-leveldelegatesand13district-levelalternates.(Rule8.C,CallI.B,I.I,AppendixB&Reg.4.34)

2. District-leveldelegatesandalternatesshallbeallocatedtopresidentialpreferencesthroughaproportionalrepresentationsystembasedonaPresidentialPreferencePrimaryheldonTuesday,March17,2020,followedbyapost-primarycaucusheldwithineachCongressionalDistrictonSaturday,April4,2020.CongressionalDistrictChairswillbe

allowedtoprovideforearlyvotinginthecongressionaldistractonThursday,April2,2020.a. TheCongressionalDistrictChairshalldeterminethelocation

ofeachCongressionalDistrictCaucusbyFebruary3,2020andreportthelocation,totheFloridaDemocraticParty.

b. AdditionalLocations:Dependingonthegeographicalsizeofthecongressionaldistrict,theCongressionalDistrictChairandotherStateCommitteemenandStateCommitteewomenwhosecountyincludesaportionofthatCongressionalDistrictmayrequestthattheStatePartyChairallowthatmorethanoneCDCaucuslocationbedesignatedtohelpmaximizeparticipationandminimizetraveldistanceandtimeforDemocraticvoterswhowishtoparticipateintheCaucus.ArequestforadditionalCDCaucuslocationsshallbesenttotheStateChairnotlaterthanFebruary13,2020.

c. CongressionalDistrictlocationsmustbelocatedwithinthecorrespondingcongressionaldistrict.

3. ApportionmentofDistrict-LevelDelegatesandAlternatesa. Florida’sdistrict-leveldelegatesandalternatesareapportioned

amongthedistrictsbasedonaformulagivingequalweighttothevotefortheDemocraticcandidatesinthe2016presidentialandthe2018gubernatorialelections.Thisisthemostinclusivemethodtorepresentthebroadstrengthofthepartyandwheregeographicallyourvotersreside.(Rule8.A,Reg.4.12,Reg.4.11&AppendixA)

b. Florida’stotalnumberofdistrict-leveldelegateswillbeequallydividedbetweenmenandwomenandshallnotvarybymorethanonevote.(Rule6.C.1&Reg.4.9)

c.Allcandidatesconsideredfordistrictlevelalternatepositionsmustmeetthesamerequirementsascandidatesfordistrictleveldelegatepositions.Candidateswhorunfordistrictleveldelegatepositionsandwerenotchosenareautomaticallyeligibletorunatthealternatelevel.(Rule13.C)

e.TheStateDemocraticChairshallcertifyinwritingtotheCo-ChairsoftheDNCRulesandBylawsCommitteewhethereachpresidentialcandidatehasusedtheirbesteffortstoensurethattheirrespectivedistrict-leveldelegatecandidatesmeettheaffirmativeactionandinclusionconsiderationsandgoalsdetailedintheAffirmativeActionsectionofthisPlanwithinthree(3)businessdaysofreturningthelistofapproveddistrict-leveldelegate

candidatesanddistrict-levelalternatecandidatesasindicatedinSectionIII.A.5.bofthisPlan.(Rule6.IandReg.4.10C)

6.FairReflectionofPresidentialPreference

a. PresidentialPrimary-ProportionalRepresentationPlan(Rule14.A,Rule14.B&Rule14.D)TheFloridapresidentialprimaryelectionisa“binding”primary.Accordingly,delegatepositionsshallbeallocatedsoastofairlyreflecttheexpressedpresidentialpreferenceoftheprimaryvotersineachdistrict.TheNationalConventiondelegatesselectedatthedistrictlevelshallbeallocatedinproportiontothepercentageoftheprimaryvotewoninthatdistrictbyeachpreference,exceptthatpreferencesfallingbelowa15%thresholdshallnotbeawardedanydelegates.

b. Ifnopresidentialpreferencereachesa15%threshold,thethresholdshall

behalfofthepercentageofthevotereceivedinthatdistrictbythefront-runner.(Rule14.F)

c. Theresultsfromthepresidentialpreferenceprimaryarecertifiedbythe

SecretaryofState10daysaftertheelection,theStatePartywillthenusetheseresultstodeterminetheallocationofdelegatesforeachCongressionalDistrictaccordingly.TheStatePartywillinformeachCongressionalDistrictChairtheallocationofthedelegatesintheirdistrict.TheCongressionalDistrictChairswillthenholdpost-primarycaucusesintheirdistrictstoelectthedistrictleveldelegates.Atthecaucus,attendeessigninanddeclarewhichpresidentialcandidatetheysupport.Attendeeswillthenbegivenaballotwiththelistofdistrict-levelcandidatespledgedtothepresidentialcandidatetheysupport.Afteralltheballotsaretallied,thehighestvotegettersofthegenderdesignatedinaccordancewiththeequaldivisionprocessdescribedbelowwillbeelected.CongressionalDistrictswhichincludesmorethanonecountycannotelectallofitsdelegatesfromthesamecounty.(Rule13.G)

7.EqualDivisionofDistrict-LevelDelegatesandAlternates

a. Inordertoensurethedistrict-leveldelegatesareequallydividedbetweenmenandwomen(determinedbygenderself-identification),thegenderofthefirstbinarydelegateelectedwithineachdistrictwillbedesignated.(Rule6.C.1&Reg.4.10)

b. Atthetimeoftheelectionofdelegatesinthedistrict,thebinarygenderadvantagewillalternatewheneverabinarydelegateoftheadvantagedgenderiselectedtoadelegateposition.Thealternationbygendershallcontinueacrosspresidentialpreferencesintheorderofthenexthighestvote-gettingpreferencesindescendingorder.

D. RepresentationGoals

1. IncooperationwiththeNationalCommittee,theFDPAffirmativeActionCommittee,theFloridaDemocraticPartyhasdeterminedthedemographiccompositionofAfricanAmericans,Hispanics,NativeAmericans,andAsianAmericansandPacificIslandersinthestate’sDemocraticelectorate.Theseconstituencypercentagesshallbeestablishedasgoalsforrepresentationinthestate’sconventiondelegation.(Rule6.A)

2. IncooperationwiththeNationalCommittee,theStatePartyhasdeterminedthedemographiccompositionofmembersoftheLGBTcommunity,peoplewithdisabilities,militaryveterans,youth,andmembersoflaborunionsinthestate’sDemocraticelectorateandfurthermore,theStatePartyhaschosentoestablishthesepercentagesasgoalsforrepresentationinthestate’sconventiondelegation.(Rule7&Reg.4.8.C.iii))

3. ThroughaprocessdirectedbytheAffirmativeActionSubcommitteeonDelegateSelection,theFloridaDemocraticPartyhasdeterminedthegoalsofrepresentationamongthe2020Delegationasfollows:

a. The2016AffirmativeActiongoalswereusedasastartingpoint.EffortswerethenundertakentodeterminethepercentageofDemocraticvoteswhichcomefromeachofthevariousconstituenciesbasedon2016voterturnout,2018voterturnoutand2016exitpolling.

b. ThosecalculationsweresupplementedwithdatafromtheVeteranNewsorganization,DisabilitiesNow’scalculations,sociologicalresearchofLGBTQAmericans,internalpostelectionpollingfromtheAFL-CIOandthedefinitionofsmallcountiesaslaidoutbytheFloridaSmallCountyCaucus.

c. TheFloridaDemocraticPartyreliedontheStatePartyVoterFiletodeterminetheethnicbreakdownofDemocraticregisteredvotersinFlorida.ThiswasfeasiblefordeterminingtheethnicbreakdownfortheAfricanAmericans,Hispanics,NativeAmericansandAsianAmericansandPacificIslanderscategories.

d. TheStatePartyVoterFilehasthreecategoriesthatclassifyavoter’sethnicity.ThefirstcategorycombinestheethnicitiesofNativeAmericanandAsianAmericanandPacificIslanderunderthecategoryofOther.Thesecondcategoryseparatesthetwoethnicitiesintodifferentgroups.Thethirdcategoryisavoter’sselfreportedethnicity.TheFloridaDemocraticPartyreliedonthe

process,including,butnotlimitedto,proceduresbywhichpersonsmayfileascandidatesfordelegateoralternate.IndividualswhoannouncetheircandidacyafterthisdatemustprovidethisfullparticipationstatementtotheChairoftheFloridaDemocraticPartynotlaterthanthirty(30)daysaftertheirannouncement.(Rule6.H.1)

3.Eachpresidentialcandidatemustsubmitdemographicinformationwithrespecttoallcandidatesfordelegateandalternatepledgedtothem.Suchinformationshallbesubmittedinconjunctionwiththelistofnamesapprovedforconsiderationasdelegateandalternatecandidatespledgedtothepresidentialcandidate.(Rule6.H.2)

4.Presidentialcandidatesshallusetheirbestefforttoensurethattheirrespectivedelegationswithinthestate’sdelegate,alternateandstandingcommitteedelegationsshallachievetheaffirmativeactiongoalsreflectedintheAffirmativeActionPlanandthattherespectivedelegationsofeachpresidentialcandidateshallbeequallydividedbetweenmenandwomen.Furthermore,presidentialcandidatesshallusetheirbesteffortsatthedistrictleveltoapprovedelegateandalternatecandidateswhomeetapplicableequaldivisionandaffirmativeactionconsiderationsinordertoachievetheaffirmativeactiongoalsandequaldivisionfortheirrespectivedelegations.(Rule6.C.,Rule6.I&Reg.4.10)

F.OutreachandInclusionProgram

1. TheStateDemocraticPartyiscommittedtohelpachievefullparticipationofthosegroupsofAmericanswhohavehistoricallybeenexplicitlydeniedtherighttovoteorwhohavebeensubjectedtodiscriminatoryandexclusionarypracticesthathavedeniedthemvotingrightsandfullparticipationinthedelegateselectionprocessandotherPartymeetings,eventsandelections,alongwithothergroupsofAmericanswhoarealsounderrepresentedinPartyaffairs.

2. Assuch,theStateDemocraticPartyhasdevelopedoutreachandinclusionprogramsandiscommittedtofullyimplementingtheprogramssothatallpersonswhowishtoparticipateasDemocratsunderstandtheyarewelcomeandencouragedtobeapartofthedelegateselectionprocessandinthePartyatthelocal,stateandnationallevels.

3. TheStatePartywillmakeaccommodationstofacilitategreaterparticipationbypeoplewithdisabilities.TheFDPwillinsurethefacilitiesusedtohouseeachstepofthecaucusprocesswillbehandicappedaccessible.Eachsitewillalsohaveapersonprovidingsignlanguagetranslationatthoselocationswhereanyexpectedparticipanthasrequestedone.RequestsmustbemadetotheFloridaDemocraticPartynolessthan5daysbeforetheeventwheresignlanguageinterpretationwillbeneeded.

4. Inadditiontotheeducation,publicityandotherstepsdescribedabove,theStatePartywill: a. Provideinformationaboutthedelegateselectionprocesstospecialtymediathat
