Air Quality and Dust
Controls within the draft Code of Construction Practise
• Emissions to the atmosphere will be controlled and managed during construction through the route-wide
implementation of the draft Code of Construction Practice (CoCP). The CoCP includes a range of mitigation measures
that are accepted by the Institute of Air Quality Management (IAQM) as being suitable to reduce impacts to as low a
level as is reasonably practicable.
Construction Traffic
• No significant effects are predicted at any sensitive receptors across Community Area 4 during construction of the
Proposed Scheme. Concentrations of NO2, PM10 and PM2.5 are within the relevant air quality standards both with
and without the Proposed Scheme.
Dust
• With the application of the mitigation measures contained in the draft CoCP, no significant effects are anticipated
from these risks associated with the dust generating activities. The basis for this conclusion can be found in Volume
5: Appendix AQ-001-004, where the scale of dust emissions and the sensitivity of the area and receptors are fully
described.

HIGH SPEED RAIL (WEST MIDLANDS – CREWE) BILL – HOUSE OF COMMONS SELECT COMMITTEE:
PETITION HS2-P2A-000080- MR AND MRS BAILEY
I am writing to you in my capacity as the Director of Hybrid Bill Delivery at HS2 Ltd, which is acting on
behalf of the Promoter of the High Speed Rail (West Midlands-Crewe) Bill (‘the Bill’) currently before
Parliament. I understand that you have a number of concerns about the impact of Phase 2A of HS2
(known as ‘the Proposed Scheme’) and have submitted a petition on that basis against the Bill in the
House of Commons.
I understand you met with my colleagues on 14 June 2018 to discuss your petition but felt it was not
necessary to discuss the issues at length.
Impact on your property
Part of your property – specifically, a parcel of land adjoining the A53 Newcastle Road - is included
within Bill limits and within surface safeguarding. This land is required temporarily for the works
associated the A53, but as I understand you have been informed, access would be retained to your
property throughout those works.
At the meeting on 14 June you asked whether the gates to the entrance of your driveway would be
demolished. Mr Bailey explained that the driveway has been designed with “bridges” to accommodate
the tree roots and if there had to be any works done, whether we would reinstate it to how it was i.e.
the gates. Based on the Bill design, the proposed haul road would cross over the driveway away from
the existing gates, so it would be possible to retain the gates. Tree planting is proposed, but this is
shown along the existing hedgerows adjacent to the A53 Newcastle Road and therefore there would be
no impact on the gates.
Blight application
Prior to the meeting on 14 June you were notified by Siobhan Flecknoe, Property Acquisition Manager,
that your Blight Notice had not been accepted and you were formally served the decision of the
Secretary of State for Transport via post on 14 June.

As discussed, you have one month from the date of formal receipt (via the post) in which you may
appeal this decision to the Upper Tribunal. Further information about the Upper Tribunal can be found

Need to Sell
We appreciate that you are concerned about the blighting effect of the Proposed Scheme on your
property. I understand that my colleagues spoke to you about the Need to Sell (NTS) scheme when they
met with you. This scheme is available to property owners who have a compelling reason to sell their
property, but are unable to do so – other than at a significant loss- due to HS2, or, if they are unable to
sell their property, would face an unreasonable burden in the next three years.
Applicants to the NTS scheme are required to provide evidence to show they meet the five set criteria
for the scheme to help an independent panel make an informed recommendation on the application.
Successful applicants would receive the full un-blighted market value of their property.

The NTS scheme will remain open for applications until 1 year after the Proposed Scheme is open to
the public.
Should you not consider the NTS is applicable to your circumstances, but still wish to make an
application to the Secretary of State to acquire your property, you may also consider making a request
for purchase of your property to be considered as an atypical property or under special circumstances.

Additional Provision
The Whitmore Heath to Madeley Tunnel report1 we published on 15 March 2018 includes a summary of
the design included in the Bill for the Proposed Scheme, which includes two short tunnels at Whitmore
Heath and Madeley, and an alternative 6.4km tunnel option between Whitmore Health and Madeley
(the ‘Single Tunnel’).
Following deposit of the Bill in July 2017, further consideration of the Proposed Scheme between
Whitmore Heath and Madeley has been undertaken. The sensitivity of this location, landscape
character, presence of ancient woodland, and impacts on agricultural land and farm holdings, were key
considerations in on-going and current design development activities.
Section 6.4.7 of the Whitmore to Madeley Tunnel report lists potential design changes, including
lowering of the alignment at the southern portal at Whitmore Heath tunnel, which would enable the
portal to be moved south of the A53 Newcastle Road and therefore the realignment of the A53
Newcastle Road and provision of an overbridge across the portal would not be required.

Further to this, during the Select Committee hearing on 18 April 2018, Tim Mould QC, Lead Counsel for
the Department for Transport, made the following statement:
“We have been considering whether, quite separately from the case for a single tunnel, whether
there are advantages in extending the Whitmore Heath tunnel southwards, beyond the A53. And
our further work on that has revealed to us that there are some construction and environmental
advantages to doing that, and indeed there is likely to be quite a significant cost saving if we do
that. The key advantage that would flow from that is that it will no longer be necessary to have a
cut and cover section to the Whitmore Heath tunnel, and it will no longer be necessary to carry
out what I think you’ve had described to you already, the rather complex engineering challenge
of running the A53 over the top of the box structure that would otherwise constitute the cut and
cover tunnel. That, again, is a free-standing design change to the published Bill scheme that we
have been pursuing and that we will say more to you – about that to you next week”.2
The southwards extension of the Whitmore Heath tunnel would (amongst other things) remove the
need for temporary diversion of A53 Newcastle Road, and avoid the need to reinstate the A53 over the
southern tunnel portal, once constructed.
The Select Committee published their First Special report of session 2017-2019 on 24 May 20183, in
which they welcomed the proposal of the southern tunnel extension (see paragraph 30).
These changes should therefore remove the need to temporarily use the land at the end of your drive,
and would result in changes to the construction activity in the vicinity of your property.
Extending the Whitmore Heath tunnel southwards remains subject to the deposit of an Additional
Provision (AP). The Promoter expects to deposit the AP and a further Supplementary Environmental
Statement (SES) around the turn of the year.
The process will be the same as for the first Additional Provision and SES for the Proposed Scheme,
which the Promoter deposited in March 2018. It would include:
publication at the point of deposit of an AP Environmental Statement (ES) and SES, both of
which would be subject to a public consultation; and
following the deposit of the AP, a fresh petitioning period for those whose property or interests
are directly and specially affected by the changes in the AP.
Between now and depositing the AP and SES, we will issue Land Interest Questionnaires (LIQs) to those
whose land may be required for the additional changes to be authorised by the AP. We will also
undertake a full environmental impact assessment of the proposed AP changes, including a transport
assessment, and draw up revised Bill plans and sections.
Once this has been progressed, we would like to offer people who are affected by the proposed AP
changes the chance to talk to us about them before we deposit the AP and the SES. Further information

Until this process has been completed, and in order to more fully understand the impact on your
property, you may consider it more appropriate to appear at the Select Committee at the time when
the AP changes are being considered, rather than proceeding to be heard on 27 June 2018.
