Through its representativebody, FEFAC, feed manufac-turers consider the EU
legislative framework an essentialelement in meeting the Lisbonobjectives for improved competi-tiveness of the livestock chain while
providing the keys to innovationfor producing better, safer andmore sustainable feeds.
The regulation repeals several existing
EU Directives and combines mandatory
requirements with co-regulation obligations
involving European representatives of feed
business sectors (stakeholders).
Key mandatory requirementsDeclaration of feed materials: Among the
key features, the elimination of the mandatory
percentage declaration of feed materials on
the compound feed label constitutes the
most significant improvement in the protec-
tion of feed industry know-how. For the
sake of transparency, feed manufacturers will
be nevertheless required, without prejudice
under the Directive on the enforcement of
intellectual Property Rights, to provide further
compositional information within a range of+/-15 percent of the value according to the
feed formulation on customers request.
Use of claims: The regulation also
foresees the possibility to make claims for
compound feed and feed materials on the
condition that the claim is objective, prop-
erly substantiated and understandable by
the customer of the feed. In case the latter
is in doubt of the truthfulness of a claim, he
can bring it to the attention of the compe-
tent authority which may either consider it
as misleading, if the claim is not sufficiently
substantiated, or ask the opinion of the EU
Commission which may also request the
European Food Safety Authority (EFSA)
for its opinion.
Issues subject to co-regulationPending the publication of the regulation
in the Official Journal of the European Union
in September 2009, FEFAC has already
established a to-do list on a number of
issues subject to co-regulation, and in par-
ticular with regard to the development
of a Community Code of Good Practices
for the Labelling of Compound Feed and
Product claims and the development of the
Community Catalogue of Feed Materials.
Community Catalogue of Feed Materials:
This voluntary and non-exhaustive Catalogue
of Feed Materials shall be composed of the
current EU non-exhaustive list of feed mate-
rials as well as the existing list of bio proteins
for which the pre-authorisation procedure is
not required anymore and shall be reviewed
by stakeholders in order to better reflect the
feed formulations used by feed manufactur-
ers throughout the EU.
These draft amendments would there-
fore be subject to the approval of the
Standing Committee on the Food Chain and
Animal Health Section Animal nutrition.Internet register of notified feed materials:
For the sake of transparency, the final text
also foresees a notification procedure of
those feed materials that are placed for the
first time on the market and that are not yet
listed in the Catalogue.
Such notified feed materials shall be first
received by stakeholders and then trans-
ferred to an internet register to be updated
on a regular basis.
Feed chain in action: To this end, EU feed
chain partners decided to adopt a pro-active
approach by establishing a dedicated joint
platform in charge of reviewing and adapting
the current EU list of feed materials on the
basis of the existing 12 categories of feed
materials.
This platform gathers together approxi-
mately 30 EU organisations including the
European Flour Millers Association, FEDIOL,
AAF, COCERAL, FERM and FEFAC. The
platform has already met several times and
aims to accelerate the working process
in order to finalise a first revision of the
Catalogue of Feed Materials. The practi-
cal discussion on the management of the
internet register will take place at a later
stage, once the first version of the revised
Catalogue is almost finalised.
All feed business operators shall comply
with the new labelling rules 12 months after
its entry into application, which is expected
to be in September 2010.

that provide for simpler rules for labelling and marketing of feed whileensuring an adequate flow of information throughout the feed chain.
