E- TENDER NOTICE FOR SUPPLY OF LAB CONSUMABLES TO ESIC SUPER
SPECIALITY HOSPITAL, SANATHNAGAR, HYDERABAD-38 E- Tenders in two bid system through E- procurement are invited from invited from manufacturers
/ authorized dealers for supply of lab consumables for various Departments in ESIC Super
speciality hospital, Sanathnagar, Hyderabad -38. (For details please visit our website
(www.esic.nic.in).
Detailed Tender Documents are available on line from the date of tender publication
(https://esictenders.eproc.in) from 25-02-2019 onwards. The interested bidders are advised to
register themselves with e-procurement Portal at - https://esictenders.eproc.in as described in the
INSTRUCTIONS to participate in the e-Tender. The bidders should upload duly signed tender
form and their bids along with scanned copies of all the relevant certificates, documents etc. in
support of their technical & price bids on the https://esictenders.eproc.in, latest by 18-03-2019
upto 1:00 P.M. Along with Earnest Money Deposit (as details given below) in favour of ESI Saving
Fund A/c. No. 01, only undertaking shall be submitted in sealed cover and dropped in the Tender
Box kept at Administration Branch, 2nd Floor, ESIC Super Speciality Hospital, Sanathnagar,
Hyderabad– 38 by 18-03-2019 up to 01:00 PM.
The technical bids will be opened online on 18-03-2019 at 2:30 PM. The tenderer / his
authorized representative can be present on the same date and time at the opening of tenders if

GENERAL INSTRUCTIONS FOR BIDDERS
The Dean, ESIC Super specialty Hospital Sanathnagar, Hyderabad invites sealed tender for Supply
of lab consumables for the hospital as per specifications detailed in the Schedule attached. The
registered Manufactures./ Distributers/ Authorized agents, who are having permanent place of
business in twin cities Hyderabad/ Secunderabad may participate in the tender.
GENERAL TERMS AND CONDITIONS FOR TENDER
1. Following are the mandatory Pre bid qualifications to consider any tender for evaluation.
Documentary proof for the same is mandatory to be submitted with tender application.
A. EARNEST MONEY.
EMD of Rs.50,000/- only is to be deposited either through Banker's cheque or
Demand Draft in favour of "ESI Saving fund Account No.1" payable at Hyderabad. Tenders
without EMD will not be entertained. EMD of unsuccessful tenderer will be returned without
any interest within one month after the award of contract. The tenderer should enclose a pre-
receipt for the same. In the event of the withdrawal / revocation of tenders after the date
specified for opening of tender, the earnest money shall stands forfeited. In the event of
acceptance of the tender the earnest money may be adjusted towards the amount of Performance
security required to be deposited by the contractor
B. EXPERIENCE:
Tenderer must have Experience of Minimum Three Years i.e. from 2016 Jan onwards in
the business of supplying desired medical/surgical/lab items to the corporate or Government
hospitals which should be supported by documentary evidence to corroborate viz certificate,
PURCHASE ORDERS or COPIES OF CONTRACTS,AGREEMENT COPY etc from various
hospitals. The purchase orders and agreements should be from January 2016 onwards (each year at
least one document).The firm should also give the undertaking as in Annexure-D
C. Tenderer must have annual turnover of Rs.30 lakhs (Rs thirty Lakhs) or above. The tenderer
must submit Annual financial reports of last three financial years duly certified by Chartered
Accountant. This report should include balance sheet with Profit & loss account.
D. Company must be a profit making one in last three years.
E.. The company should not have been ever blacklisted by any Govt. Organization/
Institution. The tenderer should submit an Undertaking for the same.
F. Following documents are mandatory to be submitted:
i. GST registration certificate
ii. Undertaking that the quoted items have not been & are not being supplied to any other
organization at rates lower than being quoted here.
iii. PAN card photocopy of the tenderer.
iv. . Undertaking as per Annexure-B
2. PREPARATION OF TENDER:
Only EMD and the undertaking should be dropped in the tender box kept in chamber of
Deputy Director Administration ESIC Superspeciality Hospital Sanathnagar Hyderabad up to 1 pm
on 18/03/2019 up to 1.00 pm. The e-tender will be opened on 18/03/2019 at 2.30 pm. If date of submission of tender is
declared a holiday, tender will be opened on the next working day at the same time. Tenders
received late will not be entertained. Tenderer/ authorised representative may attend the tender
opening process. Telegraphic/telex/fax/email/conditional/incomplete tenders will not be entertained
and shall be rejected out rightly. If any item in the schedule is not being tendered for, the
corresponding space against the item should be defaced by writing ‘not quoting’. Quotations
with vague and indefinite expressions such as ‘subject to immediate acceptance’; ‘subject to prior
sale’ etc. will not be considered.
The rates should be quoted in figures as well as in words without any overwriting/cutting/
erasing. In case there is any over writing/erasing/cutting and any discrepancy in rates in
words and figures the item will not be considered. Tenderer must quote the rates strictly as per
list of items attached with the tender form mentioning the serial no. of the item and category.
3. SIGNING OF TENDER Individuals signing tender or other documents connected with the tender
must specify the capacity in which he is signing. For authorised signatories the authorisation
certificate to be enclosed.
4. PERIOD FOR WHICH THE OFFER OF TENDERER SHOULD REMAIN OPEN: All tenders
should remain open for acceptance for a period of twelve months from the date of opening of the
tender.
5. PERIOD OF CONTRACT:
The contract / tender, if awarded, shall be valid initially for one year from the date of
award of Contract subject to continuous satisfactory performance and on failure on this
aspect by the contractor the Competent Authority reserves the right to terminate the contract. The
period of the contract can be extended for further period at the discretion of the Competent
Authority on mutual consent basis.
6. PRICES:
i) The price should be typed without any overwriting/erasing/cutting.
*The tenderer has to fill Annexure-D (format for financial bis for lab consumables) online.
Online Price Bid of only those tenderers who are found technically eligible will be opened.
* In case any discrepancy in rates in words and figures are found the item will not be considered.
* In case any discrepancy in rate/pc or rate/pack of the item, item will not be considered.
*Use of white correction fluid is strictly prohibited
ii) The prices quoted must be per unit shown in the schedule inclusive of everything like packing
and delivery charges and also GST. Amount must be clearly shown in figures and words in Indian
Currency only. The prices should not be more than mrp.
Prices should be quoted as per Performa in Annexure-D. Prices quoted in other form will not be
accepted.
7. SAMPLES: Wherever asked, the firms shall have to submit samples of item(s) for verification /
inspection, approval, etc., and the firm shall have to comply with such conditions of pre supply
inspection / verification and shall have to abide by the decisions / directions of Hospital
Authority in this regard. It is, therefore, in the own interest of the firm(s) concerned to get their
proofs / samples, etc verified / inspected before effecting supply at their own cost. Samples
supplied should not be less than the quantity necessary for the test given in the specifications
(if any). Each sample should have a card affixed to the sample
which should bear the following information:
1. Your Name and address 2. Tender Number\ 3. Date of opening of tender 4. Item no. against which sample submitted 5. Any other relevant description deemed fit.
Samples shall not be returned normally until specifically asked for within one month of opening of
tender and shall be the property of the ESIC.
8. DELIVERY TERMS
a) Delivery Period will be 2 weeks from the date of placement of Supply Order.
b) The tenderer shall deliver the stores at Hospital store of the ESIC Superspeciality Hospital
Sanathnagar Hyderabad in good order, within the limits of the time and in such quantities/qualities
as may be ordered from time to time.
c. Normally Part supply or part bill will not be accepted. However, in exceptional circumstances
the same may be accepted at the sole discretion of the competent authority of the hospital, against
clear written request from the firm.
d. All delivery challan as well as the Bills are to be submitted strictly in triplicate. Bill should
be pre-receipted with application of revenue Stamp wherever necessary. Care should be taken to
submit the delivery challan and bills duly completed and without any errors to prevent rejection /
cancellation / delay in processing of bills.
9. PENALTY: If the successful tenderer fails to execute the supply order within the stipulated
period (2 weeks from the date of issue of supply order), penalty of 2% of the value of the order
calculated at the contract rate per week or a part of a week will be levied. The maximum penalty
for late supply shall not exceed 10% of the total value of the order/orders and if the order is not
supplied after two weeks of penalty period then the items/goods will be procured from next
higher bidder/ local market and the difference will be recovered from subsequent bills/security
money deposit. The cut of date of delivery period shall be counted from the date of actual dispatch
of supply orders to date of receipt of supplies at the hospital store. If part supply is done by the
firm, risk purchase will be resorted to remaining quantity which has not been supplied. The
extra expenditure involved in procuring the supplies will be recovered in full from the firm at
the discretion of the competent authority The risk purchase so imposed will be payable by the firm
or will be deducted from the incoming bill(s)/security money of the firm.
10. LIFE PERIOD OF ITEMS :- The items supplied having shelf life should not have passed
more than 1/6th of shelf life from the date of manufacturing at the time of supply.
11. INSPECTION OF SUPPLIES: Supplies shall be accepted subject to inspection by Dean, or his
assigned representative. Any defect found in the materials will render the supplies open to
rejection and decision of the Dean, ESIC Superspeciality Hospital Sanathnagar Hyderabad shall be
the final and legally binding. The rejected store shall be returned to the suppliers and the supplier
firm(s) shall have to take the same back at their own cost and risk, and shall replace such rejections
with the items of standard specifications / quality as acceptable to the Hospital Authority.
12. TERMINATION FOR CONVENIENCE: The Purchaser, by written notice of 30 days (Thirty
days) sent to the Supplier, may terminate the contract, in whole or in part at any time for his
convenience. The notice of termination shall specify that termination is for the Purchaser’s
convenience, the extent to which performance of the Supplier under the contract is terminated and
the date upon which such termination becomes effective.
13. RESOLUTION OF DISPUTES: In case of a dispute or difference between the Purchaser and
the Supplier relating to any matter arising out of or connected with this agreement such dispute or
difference shall be referred to an arbitrator to be nominated by the Dean. The award of the
arbitrator shall be final and binding on the parties of this contract.
14. RIGHT TO MODIFY OR RELAX: The Purchaser reserves the right to modify and /or relax
any of the terms and conditions of the tender / contract.
15. ASSISTANCE TO CONTRACTOR: The contractor shall not be entitled to assistance either,
in the procurement of raw materials required for the fulfilment of the contract or in the securing of
transport facilities. i) In case of failure to comply with the provisions of the terms and conditions
mentioned, by the agency that has been awarded the contract, the hospital authority reserves the
right to award the contract to the next higher tenderer or outside agency. The contract will
be cancelled and the performance security will be forfeited in such cases.
16. PERFORMANCE SECURITY DEPOSIT : The successful tenderer shall have to submit
performance security deposit, as security deposit for the due compliance& fulfilment of terms
&conditions of the contract. This has to be in the form of a bank draft payable in favour of ESI
Saving Fund Account No.1, payable at Hyderabad, drawn on any of the nationalized bank,
preferably SBI. The amount will be 10% of the expected annual contract value as per the items
quoted by the tenderer. The exact amount will be decided by the tender evaluation committee after
finalizing the tender duly approved by the Dean and will be intimated to the successful tenderer
before signing of the contract. The decision of the committee for fixing the amount of performance
security shall be binding on the parties of this contract. On due performance and successful
completion of the contract the security money deposit shall be returned without any interest. On
unsatisfactory performance or violation of terms and conditions of the contract will make the
contractor liable for forfeiture of security deposit. The decision of Dean will be final on this
account.
17. The tenderer should have a permanent place of business in Hyderabad/Secunderabad and the
complete Postal Address, Telephone / Mobile / Fax / E-mail address, etc. should be provided, while
submitting the completed tender form.
18. The rates once accepted by the hospital shall remain unaltered throughout the period of
contract, including any extended period.
19. In case of failure to comply with the provisions of the terms and conditions mentioned, by
the agency that has been awarded the contract, the hospital authority reserves the right to cancel
the contract and forfeit the deposited performance security.
20. Selection of tender will be made strictly, on the basis of quality of the product and other
parameters to be judged by the competent authority of the hospital.
21. The tender will be rejected if:-
(a)A firm submits conditional tender.
(b)"No tax" quotations ,are not supported by a proof.
(c)All the papers are not complete.
(d)Tender is not sealed properly.
22. The Item quoted will be rejected if:
A) More than one type of rates is quoted for one Item/More than one Manufacturer/Brand
quoted for one Item.
B) Any discrepancy in rate/pc or rate/pack of the item.
C) The rates quoted are not found both in figures and words.
D) Discrepancy in rate/unit of item.
E) The quoted item is not as per specification required.
F) Discrepancy in Rate in words and figures.
23. In case the tenderer is a manufacturer, there is no need to submit authority letter for quoted
items. Bidder/Tenderer must attach original product sheet/ product list of the product quoted in the
tender for which manufacturing license were issued by concerned department, along with
manufacturing license.

In case the Tenderer is a Marketer and quotes for indigenously manufactured items, then it is
required to submit Original authority letter.
24. Bidders quoting for imported items shall also be required to submit original authority letter
from Manufacturer / Marketer-the bidder in this case can however also submit photocopy/scanned
copy of authority letter duly Self attested. However, in case the bidder is found to be technically
responsive, he will have to produce the original authorization letter at the time of submission of
samples.
25. In case of Imported items, company based in India having the marketing rights of the quoted
products (Brand) can authorize distributor for supply of items. However further sub-authorization
by authorized distributor will not be accepted. Necessary authorization documents should be
attached. The bid for the specified imported item(s) without acceptable authority letter(s) as
mentioned above, shall not be considered.
26. Fraud & Corruption: The bidder, supplier, contractor and the consultants observe the highest
standard of ethics during the procurement & execution of such contracts in pursuit of this.
Defines, for the purposes of this provision, the terms set forth below as follow:-
a)’’Corrupt Practice” means the offering, giving, receiving or soliciting directly or indirectly of
anything of value to influence the action of public official in the procurement process or in contract
execution.
b) “Fraudulent Practice” means a misrepresentation or omission of facts in order to influence a
procurement process or the execution of a contract.
c) “Collusive Practice” means a scheme or arrangement between two or more bidders with or
without the knowledge of the purchaser, designed to establish bid prices at artificial, non -
competitive levels;
d) “Coercive Practices” means harming or threatening to harm, directly or indirectly, person or
their property to influence their participation in the procurement process or affix to execution of a
contract.
e) Will reject a proposal for award if it determines that the bidder recommended for award has,
directly or through an agent, engaged in corrupt, fraudulent, collusive, coercive practices in
competing for the contract in question
27. It is the sole responsibility of the tenderer to submit the tender both Online & Manually. All
documents as listed above should be clear & legible, duly attested / notarized, properly indexed &
serially page numbered. All documents should be duly signed digitally for online submission and
manually for hard copy by the authorized signatory. Copies to be uploaded and submitted online
should be in proper resolution.
28. The above said instructions should be followed strictly , failing which the tender will be
summarily rejected.
29. The tenderer who submits false, forged or fabricated documents or conceals facts with intent to
win over the tender, EMD/performance security of such tenderer will be forfeited and firm will be
liable for blacklisting in addition to legal action as deemed fit.
