Summary

DuringPresidentObama’sadministration,thenumberofconcealedhandgunpermitshassoaredtoover14.5million–a215%increasesince2007.Amongthefindingsofourreport:

■ Theincreaseinthenumberofconcealedhandgunpermitslastyearsetanotherrecord,increasingby1.73million.Thatisslightlygreaterthanpreviousrecordof1.69millionsetthelastyear.

■ 6.06%ofthetotaladultpopulationhasapermit.■ Intenstates,morethan10%ofadultshaveconcealedhandgunpermits.

Indianahasthehighestrate—15%.SouthDakotaisclosebehindwith14.7%.

■ Florida,Pennsylvania,andTexaseachhaveoveramillionresidentswhoareactivepermitholders.

■ Inanother11states,apermitisnolongerrequiredtocarryinallorvirtuallyallofthestate.Thusthegrowthinpermitsdoesnotprovideafullpictureoftheoverallincreaseinconcealedcarry.

■ Between2012and2016,instatesthatprovidedatabygender,thenumberofwomenwithpermitshasincreasedtwiceasquicklyasthenumberofmenwithpermits.

Whetherpeopleshouldbeallowedtocarrypermittedconcealedhandgunshasbecomeacontentiousissueinthisyear'spresidentialcampaign.

AsimpleGoogleTrendssearchshowsthatpeople’sinterestinconcealedcarryhasspikedinthewakeofrecentmasspublicshootings.Takethethreeattacksthatoccurredlastfall.InterestsimilarlyspikedaftertheattacksinOrlandoandelsewhere.

Theseattackshavealsobeenfollowedbysharpincreasesinthenumberofpermitsbeingissued.Withover1.73millionnewconcealedhandgunpermitsissuedinjustthelastyear—bringingthetotalto14.5million—AmericanshaveclearlydonemorethansimplylookupinformationontheInternetaboutconcealedhandgunpermits.

Overtheyears,moreandmorestateshaveadoptedlawsallowingindividualstoobtainconcealedcarrypermits.Illinoiswasthelaststatetodoso,issuingitsfirstpermitsinMarch2014.EvenWashington,D.C.finallystartedissuingpermitsearlierthisyear.Today,permittedconcealedhandgunsareallowedineveryjurisdictionoftheUnitedStates.

Buttherulesvarygreatlyfromstatetostate.Therearenofeesortraining

requirementsintheelevenstatesthatdonotrequirepermits.Theaveragefeeforafive-yearpermitis$74.AtoneendisIllinois,whichchargesa$150feeandrequires16hoursoftraining.Thetrainingmaycost$250,resultinginatotalmonetarycostofabout$400.Bycontrast,SouthDakotahasnotrainingrequirementandchargesonly$10forafour-yearpermit.Similarly,Pennsylvaniahasnotrainingrequirementandcharges$19forafive-yearpermit.

Notsurprisingly,concealedcarryismuchmorepopularinstateswherepermitsarerelativelyinexpensiveandeasytoobtain.

Thisreportwillfocusontheincreaseinconcealedcarry.Obviously,theimportantthingfromacrimepreventionstandpointiswhetherpeopleactuallycarryguns,notwhethertheyareallowedtodoso.

It’snotjustthatmorestatesnowallowconcealedcarry.Therehasalsobeenanincreaseinpermitswithineachstate.Thelongerthatconcealedcarrylawshavebeenineffect,themoretimethatpeoplehavehadtoapplyforandreceivepermits.Butthereappearstobeanotherfactor:PresidentObama’selectionin2008.NotonlydidObama’selectionincreasegunsales,italsoincreasedthenumberofconcealedhandgunpermits.

Previously,theincreaseinpermitshadbeenrelativelyslow,growingfromroughly2.7millionpermitholdersin1999to4.6millionin2007.ButthenumberofconcealedhandgunpermitsexplodedduringtheObamapresidency.InDecember2011,theGovernmentAccountabilityOfficeestimatedthattherewereatleast8millionconcealedhandgunpermits.ByJune2014,itwas11.1million.Now,in2016,thenumberisuptoover14.5million.

Inotherwords,duringtheeightyearsfrom1999to2007,thenumberofpermitsincreasedbyabout240,000annually.Duringthenextfouryears,thenumberofpermitssurgedby850,000annually.Then,in2012and2013,theyearlyincreaseacceleratedto1,550,000.Then1,690,000lastyearand1,730,000thisyear.

Therapidincreaseinconcealedcarrypermitsismirroredbyarapidincreaseingunsales.TheNationalInstantCriminalBackgroundCheckSystem(NICS)checkssoaredfrom11.2to23.1millionbetween2007and2015.Salesin2016havegrownatanevenfasterpace.

Pollsshowalessdrasticincreaseingunownership.Butpollingreliesonpeople’swillingnesstorevealwhethertheyownagun,whichmaybeaffectedbymassshootingsorbygrowingdistrustofgovernment.1

Thebackgroundcheckmeasurehastheproblemofnotbeingabletotellusthenumberofpeoplebuyingguns.Somepeopleundergomultiplechecks,andsometimesmultiplegunsaresoldwithasinglecheck.Furthermore,peoplewhohavealreadypassedaconcealedcarrybackgroundcheckarenotalwaysrequiredtoundergoanotheroneforbuyingagun.

Concealedhandgunpermitdataisathirdmeasureofgunownership.Butthenumberofpermitsclearlyunderestimatesthetruenumberofpeoplewhocanlegallycarryconcealedhandguns.Therearethreereasonsforthis.

1) PermitsarenotrequiredintenstatesaswellasvirtuallyallofMontana.Generally,peopleinthosestatesonlyobtainpermitssothattheycancarryconcealedwhentravelingoutsideoftheirhomestate.Withnofeesorotherrequirements,thesestatesareprobablytheoneswherepeoplemostfrequentlylegallycarryconcealedguns.

2) Dataisnotreadilyavailableforafewstates.Forexample,NewHampshireonlycollectsdataonpermitsissuedtonon-residents,thoughweweregivenaconservativeestimate.AlabamaandNewYorksimplydon’tcollectthisdataatallonthestatelevel,anditisaverycumbersomeprocesstoobtaindatafromalargenumberofindividualcountiesorcities.Wewouldcollectdataforsomecountiesandthenassumethatrateissimilarfortherestofthestate.

3) Forsomestates,thedataisoneormoreyearsoldandthusmissestherecentgrowthinpermits.

Asmoreandmorestatesdecidenottorequirepermits,thenumberofpeoplewhocanlegallycarryahandgunwillincreasinglyoutpacethenumberofpermitholders.

Duetooldandmissingdata,14.5millionisundoubtedlyanunderestimateofthetotalnumberofAmericanswithpermits.Ontheotherhand,atleast687,840ofthesepermitsare“non-residential”permits,someofwhichareissuedtopeoplewhoalreadyhaveconcealedhandgunpermitsfromtheirhomestates.Mostprobablygetanon-residentialpermitinplaceoftheirstatepermitsimplybecausepermitsfromstatessuchasUtahandFloridaarehonoredinthevastmajorityofstates.Mostofthesenon-residentialpermitsareissuedbyUtahandFlorida.

Asthemaponthenextpageshows,everypartofthecountryhasbothstateswithover10percentoftheadultpopulationwithconcealedhandgunpermitsandhasastatethatalsodoesn’trequirepeopletohaveapermittocarry.

Tosummarize,thetotalnumberofpermitsintheUSisatleast14.53million.Addinpeoplewholegallycarrywithoutapermit,andthenumberclearlybecomesmuchlarger.ThetotalnumberofAmericanswithpermitscouldpossiblybelowerthan14.53million,butismostlikelyinexcessofthatfigure.

ExplainingtheNumberofPermitsIssued

Inagivenstate,thepercentageofadultswithpermitscanbeeasilyexplainedbythecostsofobtainingapermit,howmanyyearsconcealedcarrylawshavebeenineffect,andwhethergovernmentofficialshavediscretioninissuingpermits.2

Amongourfindings:

--Each$10increaseinfeescausesahalfapercentagepointdecreaseintheproportionofadultswithpermits.

--Each10yearsthatthepermitlawhasbeenineffectcausesa1.5percentagepointincreaseintheproportionofadultswithpermits.

--Governmentdiscretioninissuingpermitsisassociatedwithatwo-thirdsreductioninthepercentageofadultswithpermits.

DeterringCrime

Manyfactorsaffectcrimerates,amongthem:arrestandconvictionrates,policingpolicies,prison,demographics,income,poverty,andeducation.Butconcealedcarrylawsarealsopartofthisstory,especiallywhenalargepercentageofthepopulationhaspermits.Theoverwhelmingmajorityofpeer-reviewedacademicresearchbyeconomistsandcriminologistsconcludesthatownershipofpermittedconcealedhandgunscausesareductioninviolentcrime.Thedebateisbetweenthoseclaimingareductionincrimeandthosedenyinganyeffect(forasurvey,seeLott,“Whatabalancingtestwillshowforright-to-carrylaws,”UniversityofMarylandLawReview(2012):1205-1218).

Mostresearch,however,focusesonwhatstatesallowright-to-carry,notthemorerelevantquestionofhowmanypeopleareactuallycarrying.(Onlypeer-reviewedstudiesbyJohnLottinthesecondandthirdeditionsofMoreGuns,LessCrime[UniversityofChicagoPress,2000and2010]usethenumberofpermitstomeasuretheimpactofconcealedcarrylaws).Empiricaltestsshouldmeasurewhethercrimeratesfellrelativelymoresharplyinthosestateswiththelargestpercentageofpermitholders.

In2014,thesevenstatesthatallowedconcealedcarrywithoutapermithadmuchlowerratesofmurderandviolentcrimethandidthesevenjurisdictionswiththelowestpercentageofpermitholders.Indeed,themurderratewas31percent

lowerinthestatesnotrequiringpermits.Theviolentcrimeratewas28percentlower.

Comparedtotherestofthecountry,the25stateswiththehighestratesofpermit-holdingexperiencedmarkedlylowerratesofmurderandviolentcrime.

Ofcourse,suchacomparisonisfartoosimplistic.Therearemanyfactorsthatinfluencecrime,andsimple,cross-sectionalcomparisonsareunabletoaccountforallofthem.Wecanaccountfordifferencesacrossstatesonlybylookingathowcrimeratesvarybeforeandafterchangesinastate’spermitrules.

Stateshaveadoptedconcealedhandgunlawsindifferentyearsandissuedpermitsatdifferentrates.Thisallowsforrevealingcomparisons(seeAppendixforalargeandgrowingbodyofpeer-reviewedliterature).Onemustlookacrossstatesandcomparechangesincrimerateswithchangesintheratesofpermitholding.Doingsohasconsistentlyrevealedaverystrongrelationshipbetweenmorepermitsandlessviolentcrime(e.g.,Lott,MoreGuns,LessCrime,UniversityofChicagoPress2010andLott,2012).

Ouranalysispresentedheredoesn’tprovidesuchsophisticatedestimatessimplybecausethenecessarydatawillnotbeavailableforatleastacoupleofyears.Thus,thisreportshouldonlybeviewedassuggestive.3

Insteadofjustcomparingstatesthatdon’trequirepermitswiththosethatdo,itisalsopossibletolookatstatesthatrequirepermits.Afteraccountingforthepercapitanumberofpoliceandnewprisonadmissionsaswellasdemographics,thisstatelevelpermitdatasuggeststhateachonepercentagepointincreaseinthepercentoftheadultpopulationholdingpermitsisroughlyassociatedwitha25percentdropinthemurderrate.4

Sincethelateststatelevelcrimedataisonlyavailablethrough2014,the2011and2014permitandmurderdatashowsthatthosestatesthathadthebiggestincreasesinpermitshadthebiggestpercentagedropinmurderrates.A10percentincreaseintheshareoftheadultpopulationwithpermitsreducesthemurderrateby1.4percent.5

TheChangingGenderofPermitHolders

Dataforsevenstatesshowageneralupwardtrendinthepercentageofpermitholderswhoarewomen.

■ Arizona:thepercentageofpermitholderswhoarewomenrosefrom20.7%in2012to21.2%in2016

■ Florida:from18%inMay2012to24.1%inMay2016.

■ Indiana:from18.0%inJune2012to22.7%inMarch2015.

■ Louisiana:from18.3%in2009to24.8%in2014.

■ NorthCarolina:from21.3%inJune2012to27.5%inMarch2015

■ NorthDakota:from11.2%in2010to24.9%in2014.

■ Tennessee:from23.3%in2008to31.2%in2016.

■ Texas:from17.26in2004to25.8%in2015.

■ WashingtonState:between2005and2014,“thegrowthrateforwomengettingnewpermits[was]twiceasfastasthatofmen.”6

Ineightstateswherewehavedatabygender,since2012thenumberofpermitshasincreasedby161%forwomenandby85%formen.

Thereisalsosomeverylimiteddataonpermitissuancebyrace.Texasprovides

detailedinformationonbothraceandgenderfrom1996through2014.7Thestate’sdataindicatethatpermittinghasincreasedfastestforblacks,followedcloselybyAsians.Whilewhitesstillholdthevastmajorityofpermits,thenumberofblackpermitholdershasgrownmorethantwiceasquicklyasthenumberofwhitepermitholders.

Thegrowthinpermit-holdingbyAsians,blacks,andAmericanIndianswasbyfarthefastestaftertheminimumtrainingrequirementswerereducedfrom10hourstofourin2013.Between2012and2014,thenumberofblackpermitholdersincreasedfrom10,389to17,594.Asianpermitholdersgrewfrom3,286to5,822.Reducingthecostofobtainingpermitsseemstohavehaditsbiggestimpactonminorities.

Whenpermitdataisbrokendownbyraceandgender,wefindthatratesofpermitholdingamongAmericanIndian,Asian,black,andwhitefemalesallgrewmuchfasterthantheratesformalesinthoseracialgroups.Concealedcarryhasincreasedmostrapidlyamongblackfemales.From2000to2015,therateofgrowthwas3.81timesfasterthanamongwhitefemales.

PermitHoldersareExtremelyLaw-abiding

Itisveryrareforpermitholderstoviolatethelaw.Inordertoappreciatehowincrediblyrarethoseproblemsare,oneneedstorememberthatthereareover12.8millionpermitholdersintheUS.Indeed,itisimpossibletothinkofanyothergroupintheUSthatisanywherenearaslaw-abiding.

Togetanideaofjusthowlaw-abidingconcealedhandgunpermitholdersare,weneedonlycomparethemtopolice.AccordingtoastudyinPoliceQuarterly,policecommittedanaverageof703crimesperyearfrom2005to2007.8113oftheseinvolvedfirearmsviolations.Thisislikelytobeanunderestimate,sincenotallpolicecrimesreceivemediacoverage.Theauthorsofthestudymayalsohavemissedsomemediareports.

Sohowlaw-abidingarepolice?Withabout685,464full-timepoliceofficersintheU.S.from2005to2007,wefindthattherewereabout103crimesperhundredthousandofficers.FortheU.S.populationasawhole,thecrimeratewas37timeshigher--3,813perhundredthousandpeople.

Perhapspolicecrimesareunderreportedduetoleniencyfromfellowofficers,butthevastcrimegapbetweenpoliceandthegeneralpopulaceisreallyundeniable.

Concealedcarrypermitholdersareevenmorelaw-abidingthanpolice.BetweenOctober1,1987andJune30,2015,Floridarevoked9,999concealedhandgunpermitsformisdemeanorsorfelonies.9Thisisanannualrevocationrateof12.8permitsper100,000.In2013(thelastyearforwhichdataisavailable),158permitholderswereconvictedofafelonyormisdemeanor–aconvictionrateof22.3per100,000.10CombiningthedataforFloridaandTexasdata,wefindthatpermitholdersareconvictedofmisdemeanorsandfeloniesatlessthanasixththerateforpoliceofficers.

Amongpolice,firearmsviolationsoccuratarateof16.5per100,000officers.AmongpermitholdersinFloridaandTexas,therateisonly2.4per100,000.10Thatisjust1/7thoftherateforpoliceofficers.Butthere'snoneedtofocusonTexasandFlorida—thedataaresimilarinotherstates.

WhyistheNumberofPermitsIncreasing?

Thesurgeinconcealedhandgunpermitscorrespondscloselywithopinionpollsonguns.TakeaseriesofpollsbythePewResearchCenter.InDecember2012,respondentssaidbyamarginof48-to-37percentthatowningagun,“protectedthemfrombeingcrimevictims”asopposedto“puttingpeople’ssafetyatrisk.”11ByDecember2014,people’spositiveimpressionofgunshadgrowntoamarginof57-to-38.

SimilarchangeswerefoundinpollsbyGallupandbyABCNews-WashingtonPost.12Theyaskamorenarrowquestion:whetherhavingaguninthehomemakesthehomesaferormoredangerous.Thechangehasbeendramatic.In2000,Gallupfoundthatonly35percentofAmericansthoughtthatowningagunmadetheirhomesafer.By2014,thatnumberhadsoaredto63percent.

It'snotjustthatAmericansthinkthathavingagunmakesthemsaferasindividuals.Theyalsofeelbetterknowingthattheirneighborsarearmed.ARasmussenpollfromthispastJunefoundthata68-to-22percentmarginAmericans“feelsaferinaneighborhoodwheregunsareallowed.”13

ApollbyPEWhelpstoexplainwhytherehasbeensuchalargeincreaseinconcealedhandgunpermitsamongblacksandwomen.Thepollshowsa25percentagepointincreaseintheproportionofblackswithafavorableviewofguns.Thisisthelargestincreaseofanygroup.Theincreaseamongallwomenwas11percentagepoints,andtheincreaseamongmenwas8percentagepoints.
