AN ACT EXPANDING AND STRENGTHENING THE CASH AND OTHER NON-MONETARY BENEFITS AND INCENTIVES FOR NATIONAL ATHLETES, NATIONAL ATHLETES WITH DISABILITY OR DIFFERENTLY·ABLED ATHLETES, COACHES AND TRAINERS, AMENDING FOR THE PURPOSE CERTAIN PROVISIONS OF

. REPUBLIC ACT NUMBERED NINETY HUNDRED AND SIXTY·FOUR, OTHERWISE KNOWN AS 'NATIONAL ATHLETES, COACHES AND TRAINERS BENEFITS AND INCENTIVES ACT OF 2001' AND FOR OTHER PURPOSES

1 Be it enacted by the Senate and the House of Representatives of the Philippines in Congress

2 assembled:

4 SECTION. 1. Section 3 of Republic Act No. 9064 is hereby amended to read as

5 follows:

7 "SEC. 3. Definition of Terms - For purposes of this Act, the following terms

8 shall be defined as follows:

9

10 (a) National Athletes - shall refer to athletes who are Filipino citizens, members

11 of the national training pool, recognized and accredited by the Philippine Olympic

12 Committee (POC) and the Philippine Sports Commission (PSC), INCLUDING

13 ATHLETES WITH DISABILITIES (AWD) WHO ARE RECOGNIZED AND

14 ACCREDITED BY THE NATIONAL PARALYMPIC COMMITTEE

15 PHILIPPINES (NPC PHIL) AND THE PSC and who have represented the

16 country in international competitions. IT SHALL ALSO REFER TO ATHLETES

17 WHO ARE NOT MEMBERS OF THE NATIONAL TRAINING POOL BUT

18 WHO HAVE OTHERWISE REPRESENTED THE COUNTRY IN

19 INTERNATIONAL COMPETITIONS;

1 (b) National Coaches and Trainers - shall refer to coaches and trainers OF

2 NATIONAL ATHLETES, who are Filipino citizens, members of the national

3 coaches and trainers pool, recognized and accredited by the PSC AND POC, OR

4 THE PSC AND NPC PHIL IN THE CASE OF A WD COACHES AND

5 TRAINERS who have represented the country as official coaches and trainers to national

6 athletes in international competitions;

(c) International Competitions

ASEAN/SOUTHEAST ASIAN

- shall refer

AGE-GROUP

to WORLD, ASIAN,

CHAMPIONSHIPS AND

10 international sports competitions which are sanctioned by the INTERNATIONAL

11 SPORTS FEDERATIONS (ISFs), International Olympic Committee (IOC),

12 INTERNATIONAL PARALYMPIC COMMITTEE (IPC), FAR EAST & SOUTH

13 PACIFIC GAMES FOR THE DISABLED (FESPIC), INTERNATIONAL

14 ORGANIZATION OF SPORT FOR THE DISABLED (IOSD), held every four (4)

15 OR TWO (2) YEARS OR HELD ANNUALLY including qualifying

16 championships in team sports wherein only one (1) or two (2) countries may qualify

17 for the Olympics or World championships.

18

19 Competitions granting pnze money or those held in honor of any personality or

20 sponsor shall not be included;

21

22 (D) NATIONAL ATHLETES WITH DISABILITY OR DIFFERENTLY-ABLED

23 ATHLETES - SHALL REFER TO ATHLETES WHO ARE FILIPINO

24 CITIZENS, MEMBERS OF THE NATIONAL SPORTS ASSOCIATION FOR

25 THE DISABLED, RECOGNIZED AND ACCREDITED BY THE PHILIPPINE

26 SPORTS COMMISSION (PSC) AND THE NATIONAL PARALYMPIC

27 COMMISSION, AND WHO HAVE REPRESENTED THE COUNTRY IN

28 INTERNATIONAL COMPETITIONS."

31 SEC. 2. Section 4 of Republic Act No. 9064 is hereby amended to read as follows:

33 "SEC. 4. Benefits and Privileges for National Athletes, NATIONAL

34 ATHLETES WITH DISABILITY OR DIFFERENTLY-ABLED ATHLETES,

35 Coaches and Trainers - Any national athlete, NATIONAL ATHLETE WITH

36 DISABILITY OR DIFFERENTLY-ABLED ATHLETE, coach and trainer who is

37 currently registered as such before the PSC AND/OR NPC PHIL shall be entitled to the

38 following:

1 (a) the grant of twenty percent (20%) discount from all establishments relative to

2 the utilization of transportation services, hotels, and other lodging

3 establishments, restaurants and recreation centers and purchase of medicine and

4 sports equipment anywhere in the country FOR THE ACTUAL AND

5 EXCLUSIVE USE OR ENJOYMENT OF THE NATIONAL ATHLETE,

6 NATIONAL ATHLETES WITH DISABILITY OR DIFFERENTLY-ABLED

7 ATHLETES, COACH AND TRAINER;

8 (b) minimum of twenty percent (20%) discount on admission fees charged by theaters,

9 cinema houses and concert halls, circuses, carnivals, and other similar places

10 of culture, leisure and amusement FOR THE ACTUAL AND EXCLUSIVE

11

USE OR ENJOYMENT OF THE NATIONAL ATHLETE, NATIONAL

ATHLETES WITH DISABILITY OR DIFFERENTLY-ABLED

13 ATHLETES, COACH AND TRAINER;

14 (c) free medical and dental consultations in private or GOVERNMENT [public)

15 hospitals and similar establishments anywhere in the country [and medical

16 insurance program to be provided by the Philippine Health Insurance

17 Corporation (PHIC)); AND FREE COVERAGE IN THE NATIONAL HEALTH

18 INSURANCE PROGRAM OF THE PHILIPPINE HEALTH INSURANCE

19 . CORPORATION (PHIC) THRU THE SPONSORED PROGRAM OF THE

20 PSC;

25 Such privately-owned establishments shall enjoy tax [credits) DEDUCTIONS

26 equivalent to the discounts extended to the NATIONAL athletes, COACHES AND

27 TRAINERS."

31 SEC. 3. Section 5 of Republic Act No. 9064 is hereby amended to read as follows:

33 "SEC. 5. Scholarships. - A national athlete, NATIONAL ATHLETE WITH

34 DISABILITY OR DIFFERENTLY-ABLED ATHLETE, who wins in an international

35 competition EXCEPT SEA GAMES OR ASEAN PARA GAMES or anyone qualified

36 member of his[j) OR her immediate family within the fourth civil degree of

37 consanguinity shall be entitled to scholarship benefits in the form of tuition fees in

38 state colleges and universities in order to complete a college or university degree.

1 The winning national athlete, shall likewise be given priority III the availment of

2 state college and university scholarship grants.

4 Likewise, the Commission on Higher Education (CHED) and the Technical Education

5 Skills and Development Authority (TESDA) shall give priority to winning national

6 athletes, NATIONAL ATHLETES WITH DISABILITY OR DIFFERENTLY-

7 . ABLED ATHLETES, who seek scholarship grants and study under their programs

8 subject to the qualifications for all applicants.

9 Private colleges and universities shall likewise be encouraged to adopt a similar

10 program III their institutions for winning national athletes, NATIONAL

11 ATHLETES WITH DISABILITY OR DIFFERENTLY-ABLED ATHLETES."

13 SEC. 4. Section 6 of Republic Act No. 9064 is hereby amended to read as follows:

15 "SEC. 6. Retirement Benefits. - Any national athlete, NATIONAL

16 ATHLETE WITH DISABILITY OR DIFFERENTLY-ABLED ATHLETE,

17 coach and trainer who wins A GOLD MEDAL OR PLACES 1ST in an international

18 competition or has coached or trained such winning national athlete, NATIONAL

19 ATHLETE WITH DISABILITY OR DIFFERENTLY-ABLED ATHLETE [shall

20 receive a lump sum amount equivalent to twenty-five percent (25%) of his/her total

21 cash incentives computed from the start of his Iher active sports career as a member

22 of the national training pool or national coaches and trainers pool up to the last day

23 of retirement from active competition or training as certified by the PSc. Such lump

24 sum amount shall be extended sixty (60) days after the filing of the retirement papers.]

25 EXCEPT SEA GAMES OR ASEAN PARA GAMES, UPON REACHING THE

AGE OF FIFTY -FIVE

RETIREMENT BENEFITS:

(55), SHALL RECEIVE THE FOLLOWING

A. FOR INDIVIDUAL EVENTS - A LIFETIME MONTHLY PENSION OF AT

LEAST TWENTY THOUSAND PESOS (P20,OOO.OO) FOR INDIVIDUAL

WINNERS;

B. FOR TEAM EVENTS - A LIFETIME MONTHLY PENSION OF AT

LEAST FIFTEEN THOUSAND PESOS (PI5,OOO.OO) FOR EACH TEAM

MEMBER.

PROVIDED HOWEVER, THAT FOR NATONAL ATHLETES, COACHES

AND TRAINERS WHO WIN IN BOTH INDIVIDUAL AND TEAM EVENTS,

THE RETIREMENT BENEFIT FOR INDIVIDUAL EVENTS SHALL APPLY.

PROVIDED FURTHER, THAT, ATHLETES, COACHES AND TRAINERS

WHO ARE STILL ACTIVELY EMPLOYED AT THE TIME THEY REACH

THE AGE OF FIFTY·FIVE (55) AND HAVE AVAILED OF THE

RETIREMENT BENEFITS UNDER THIS ACT MAY CONTINUE WITH

SUCH EMPLOYMENT.

11 PROVIDED, FINALLY, THAT THE RETIREMENT BENEFITS UNDER

12 THIS ACT SHALL BE SEPARATE AND DISTINCT FROM THE

13 MANDATORY RETIREMENT BENEFITS UNDER EXISTING LAWS."

15 SEC. 5. Section 7 of Republic Act No. 9064 is hereby amended to read as follows:

16

17 "SEC. 7. Death Benefits. - Upon the death of any national athlete, NATIONAL

18 ATHLETE WITH DISABILITY OR DIFFERENTLY-ABLED ATHLETE, coach

19 and trainer, his/her primary beneficiaries shall be entitled to a lump sum benefit of Thirty

20 thousand pesos (P30,000) to cover for his/her funeral services: Provided, That if

21 he/she has no primary beneficiaries, his/her secondary beneficiaries shall be entitled to

22 . said benefits.

24 For purposes of this Act, primary beneficiaries shall refer to the legitimate spouse

25 WIDOW OR WIDOWER, legitimate or illegitimate children. Secondary beneficiaries

26 shall refer to the parents, and in their absence, to the brothers or sisters of such athlete,

27 coach and trainer."

29 SEC. 6. Section 8 of Republic Act No. 9064 is hereby amended to read as follows:

31 "SEC. 8. Cash Incentives for National Athletes, NATIONAL ATHLETES

32 WITH DISABILITY OR DIFFERENTLY-ABLED ATHLETES. - National athletes,

33 NATIONAL ATHLETES WITH DISABILITY OR DIFFERENTLY-ABLED

34 ATHLETES who win gold, silver and bronze medals in international competitions shall

35 be entitled to cash awards in the following amounts:

(1) Five million pesos (P5,000,000.00) for Olympic AND/ OR

PARALYMPIC Games;

(2) Two million five hundred thousand pesos (P2,500,000.00) for ALL

quadrennial World Championships;

(3) TWO MILLION PESOS (P2,000,000.00) FOR THE WORLD CUP

AND WORLD GAMES;

[(3)] (4) One Million Pesos (pl,OOO,OOO.OO) for Asian Games AND/ OR

FESPIC GAMES, WHICH WILL BE HELD UNTIL 2006, TO BE

REPLACED BY THE ASIAN PARA GAMES STARTING 2010;

[(4)] (5) One hundred thousand pesos (P100,000) for Southeast Asian Games

(SEA Games) AND/ OR ASEAN PARA GAMES.

(b) For silver medalists: .

(1) Two million five hundred pesos (P2,500,OOO.00) for Olympic AND/OR

PARALYMPIC Games;

(2) One million pesos (Pl,OOO,OOO) for ALL quadrennial World

Championships;

(3) SEVEN HUNDRED THOUSAND PESOS (P700,000.00) FOR THE

WORLD CUP AND WORLD GAMES;

[(3)] (4) Five Hundred Thousand Pesos (P500,000.00) for Asian Games

AND/OR FESPIC, WHICH WILL BE HELD UNTIL 2006, TO BE

REPLACED BY THE ASIAN PARA GAMES STARTING 2010;

[(4)] (5) Fifty thousand pesos (P50,000) for Southeast Asian Games (SEA

Games) AND/OR ASEAN PARA GAMES.

(c) For bronze medalists:

(1) One million pesos (Pl,OOO,OOO.OO) for Olympic AND/OR

PARALYMPIC Games;

(2) Five Hundred Thousand Pesos (P500,000.00) for ALL quadrennial World

Championships;

(3) TWO HUNDRED FIFTY THOUSAND PESOS (P250,000.00) FOR

THE WORLD CUP AND WORLD GAMES;

[(3)] (4) One Hundred Thousand Pesos (P100,000.00) for Asian Garnes

AND/OR FESPIC, WHICH WILL BE HELD UNTIL 2006, TO BE

REPLACED BY THE ASIAN PARA GAMES STARTING 2010;

[(4)] (5) Ten thousand pesos (PIO,OOO) for Southeast Asian Garnes (SEA

Garnes) AND/OR ASEAN PARA GAMES.

7 B. TEAM EVENTS

9 For competitions with less than five (5) participants per team, the team shall

10 receive the same cash awards for individual medal winners as herein provided, to

11 be divided equally among the team members actually present during the competition.

13 For competitions with five (5) or more participants per team, the team shall

14 receive [twice] THREE TIMES the cash awards for individual winners to be divided

15 equally among the team members actually present during the competition.

16

17 Provided, That for demonstration and exhibition sports events in the

18 Olympic AND/ OR PARALYMPIC Games, winning national athletes, NATIONAL

19 ATHLETES WITH DISABILITY OR DIFFERENTLY-ABLED ATHLETES

20 shall receive fifty percent (50%) of the cash awards for Olympic AND/OR

21 PARALYMPIC medalists as herein provided;

22 [Provided, further, That for SEA Garnes, monetary incentives shall be given

23 starting 2001 to the winning athletes or teams who have equaled or surpassed the

24 existing game records or the previous placing in non-measurable events.]

26 C. AGE GROUP COMPETITIONS

27

28 FOR NATIONAL ATHLETES AND NATIONAL ATHLETES WITH

29 DISABILITY OR DIFFERENTLY-ABLED ATHLETES IN AGE-GROUP

30 COMPETITIONS, ONLY THOSE WHO ARE MEMBERS OF THE

31 NATIONAL POOL, ACCREDITED AND RECOGNIZED BY THEIR

32 RESPECTIVE NATIONAL SPORTS ASSOCIATIONS AND THE

33 PHILIPPINE SPORTS COMMISSION, SHALL BE ENTITLED TO THE

34 FOLLOWING CASH AWARDS:

(A) FOR GOLD MEDALISTS:

(1) THREE HUNDRED THOUSAND PESOS (P300,000.00) FOR ALL

QUADRENNIAL WORLD CHAMPIONSHIPS;

(2) ONE HUNDRED THOUSAND PESOS (P100,000.00) FOR ASIAN

GAMES ANDIOR FESPIC GAMES, WHICH WILL BE HELD

UNTIL 2006, TO BE REPLACED BY THE ASIAN PARA GAMES

STARTING 2010;

(3) FIFTEEN THOUSAND PESOS (P15,000) FOR SOUTHEAST

ASIAN GAMES (SEA GAMES) AND/ OR ASEAN PARA GAMES.

(B) FOR SILVER MEDALISTS:

(1) ONE HUNDRED FIFTY THOUSAND PESOS (P150,000.00) FOR

ALL QUADRENNIAL WORLD CHAMPIONSHIPS;

GAMES AND/ OR FESPIC, WHICH WILL BE HELD UNTIL 2006,

TO BE REPLACED BY THE ASIAN PARA GAMES STARTING

2010;

(3) TEN THOUSAND PESOS (P10,000) FOR SOUTHEAST ASIAN

GAMES (SEA GAMES) ANDIORASEAN PARA GAMES.

(C) FOR BRONZE MEDALISTS:

(1) SEVENTY FIVE THOUSAND PESOS (P75,000.00) FOR ALL

QUADRENNIAL WORLD CHAMPIONSHIPS;

(2) FIFTY THOUSAND PESOS (P50,000.00) FOR ASIAN GAMES

ANDIOR FESPIC, WHICH WILL BE HELD UNTIL 2006, TO BE

REPLACED BY THE ASIAN PARA GAMES STARTING 2010;

(3) FIVE THOUSAND PESOS (P5,000) FOR SOUTHEAST ASIAN

GAMES (SEA GAMES) ANDIORASEAN PARA GAMES.

33 THEY SHALL ALSO BE ENTITLED TO ELEMENTARY, HIGH SCHOOL AND

34 COLLEGE EDUCATIONAL SCHOLARSHIP, AS THE CASE MAY BE, IN

35 STATE·RUN EDUCATION INSTITUTIONS.

SEC. 7. Section 9 of Republic Act No. 9064 is hereby amended to read as follows:

3 "SEC. 9. Benefits, Privileges and Incentives for Past Achievers. - Any national

4 athlete, NATIONAL ATHLETE WITH DISABILITY OR DIFFERENTLY ·ABLED

5 ATHLETE who, prior to the enactment of this Act, had won gold, silver or bronze

6 medals in international competitions except SEA Games AND/OR ASEAN PARA

7 GAMES, shall be entitled to the benefits and privileges provided under Section 4 and

8 fifty percent (50%) of the cash incentives provided under Section 8 of this Act.

9 Such incentives shall be the difference between the cash award received under

10 Administrative Order No. 35~ OR FROM OTHER GOVERNMENT AGENCIES and

11 the cash award provided under this Act."

13 SEC. 8. Section 10 of the said Act is hereby amended to read as follows:

14

15 "Sec. 10. Incentives for Coaches and Trainers. - Coaches and trainers shall also

16 be entitled to cash awards if they have personally trained and rendered service to

17 the athletes or teams WHO WIN IN INTERNATIONAL COMPETITIONS at

18 least [one (1) year] SIX (6) MONTHS prior to the international competition.

19 Certification to this effect by the individual athlete or TEAM MANAGER FOR

20 TEAM EVENTS shall be 111 writing, DULY ATTESTED BY THEIR

21 RESPECTIVE NATIONAL SPORTS ASSOCIATIONS (NSAs).

25 There is hereby created a body to be known as the Philippine Coaches

26 Accreditation Council that shall accredit and recognize coaches and trainers. It shall

27 be composed, among others, of representatives from the PSC, POC, NPC PHIL and

28 the academic community, preferably a professor in physical education or sports

29 science."

SEC. 9. A new Section lO-A is hereby inserted to read as follows:

33 "SEC lO·A. AVAILMENT OF BENEFITS AND PRIVILEGES· THE

34 ABOVE·MENTIONED BENEFITS AND PRIVILEGES SHALL BE AVAILED

35 BY ATHLETES, COACHES AND TRAINERS UPON PRESENTATION OF

36 AN IDENTIFICATION CARD, RENEWABLE EVERY YEAR, TO BE

37

38

ISSUED BY THE PSC AND/ OR NPC PHIL.

1 PROVIDED THAT, IN CASE OF ATHLETES WHO ARE NON-MEMBERS OF

2 THE NATIONAL TRAINING POOL, THE IDENTIFICATION CARD SHALL

3 ONLY BE ISSUED TO WINNING ATHLETES WHO ARE ACTIVE AND WHO

4 CONTINUE TO PARTICIPATE IN INTERNATIOANAL COMPETITIONS.

5 PROVIDED FURTHER, THAT ATHLETES WITH DISABILITIES SHALL NOT

6 AVAIL OF SAID BENEFITS AND PRIVILEGES IN COMBINATION WITH

7 SIMILAR BENEFITS AND PRIVILEGES UNDER RA 9442 OTHERWISE

8 KNOWN AS THE MAGNA CARTA FOR DISABLED PERSONS."

10 SEC. 10. A new provision in Republic Act 9064 is hereby added to be known as the new

11 Section 12. The provision shall read:

13 "SEC. 12. WINNING FILIPINO OLYMPIAN TO ENJOY THE

14 PRIVILEGE OF BEING TAX FREE FOR LIFE AND OTHER INCENTIVES - IN

15 ADDITION TO THE TAX EXEMPTION FROM INCOME TAX OF PRIZES,

16 WINNINGS AND AWARDS GRANTED TO ATHLETES IN LOCAL AND

17 INTERNATIONAL SPORTS TOURNAMENTS AND COMPETITIONS

18 . PROVIDED IN THIS ACT AND IN REPUBLIC ACT 7549, A WINNING

19· FILIPINO OLYMPIAN SHALL HAVE THE PRIVILEGE OF BEING 'TAX-

20 FREE FOR LIFE' OR THE EXEMPTION FROM PAYING INCOME TAX

21 AND ALL OTHER TAXES THAT MAY BE IMPOSED RELEVANT TO

22 THE SPORTS WHERE HE/SHE REPRESENTED THE COUNTRY AND WON

23 IN THE OLYMPICS, INCLUDING THE CAMPAIGN TO POPULARIZE OR

24 PROPAGATE THE SAID SPORTS.

26 A WINNING FLIPINO OLYMPIAN SHALL RECEIVE A MONTHLY

27 PENSION OF TEN THOUSAND PESOS (PHP 10,000.00) TO COMMENCE FIVE

28 (5) YEARS AFTER WINNING THE OLYMPICS AND SHALL CONTINUE

29 FOR TWENTY YEARS OR UNTIL THE AGE OF SIXTY (60), AT THE

30 OPTION OF THE WINNING FILIPINO OLYMPIAN."

32 FOR THE PURPOSE OF THIS ACT, THE TERM WINNING FILIPINO

33 OLYMPIAN COVERS BOTH INDIVIDUAL ATHLETES, NATIONAL

34 ATHLETES WITH DISABILITY OR DIFFERENTLY-ABLED ATHLETES,

35 WHO REPRESENTED THE COUNTRY AND PLAYED AS FILIPINOS OR

36 THOSE WHO COMPETED AS PART OF THE PHILIPPINE TEAM AND

37 MERITED EITHER GOLD, SILVER OR BRONZE MEDAL, AWARD OR

38 DISTINCTION IN A COMPETITION SPORTS.

1 A WINNING FILIPINO OLYMPIAN WHO, PRIOR TO THE

2 ENACTMENT OF THIS ACT, WON IN THE OLYMPICS SHALL BE

3 ENTITLED TO THE BENEFITS AND PRIVILEGES PROVIDED UNDER

4 THIS ACT."

6 SEC. 11. A new section, Section 13, is hereby inserted to read as follows:

8 "SEC 13. PENALTIES. -

AND (C) OF THIS ACT SHALL SUFFER THE FOLLOWING PENALTIES:

(1) FOR THE FIRST VIOLATION, A FINE OF NOT LESS UlAN FIFTY

THOUSAND PESOS (P50,OOO.OO) BUT NOT EXCEEDING ONE

HUNDRED THOUSAND PESOS (PIOO,OOO.OO) OR IMPRISONMENT

OF NOT LESS THAN SIX (6) MONTHS BUT NOT MORE THAN

TWO (2) YEARS, OR BOTH AT THE DISCRETION OF THE COURT;

AND

(2) FOR ANY SUBSEQUENT VIOLATION, A FINE OF NOT LESS THAN

ONE HUNDRED THOUSAND PESOS (PIOO,OOO.OO) BUT NOT

EXCEEDING TWO HUNDRED THOUSAND PESOS (P200,OOO.OO) OR

IMPRISONMENT FOR NOT LESS THAN TWO (2) YEARS BUT

NOT MORE THAN SIX (6) YEARS, OR BOTH.

(B) ANY NATIONAL ATHLETE, COACH, TRAINER OR ANY PERSON

WHO ABUSES THE PRIVILEGES GRANTED HEREIN SHALL BE

PUNISHED WITH IMPRISONMENT OF NOT LESS UlAN SIX (6)

MONTHS OR A FINE OF NOT LESS THAN FIVE THOUSAND PESOS

(P5,OOO.OO), BUT NOT MORE THAN FIFTY THOUSAND PESOS (P50,OOO),

OR BOTH, AT THE DISCRETION OF THE COURT. PROVIDED,

HOWEVER, THAT SUCH VIOLATION SHALL NOT DEPRIVE THE

CONCERNED NATIONAL ATHLETE, COACH OR TRAINER FROM

RECEIVING THE BENEFITS AND PIUVILEGES GRANTED UNDER THIS

ACT.

(C) IF THE VIOLATOR IS A CORPORATION, PARTNERSHIP OR ANY

JURIDICAL PERSON, THE PENALTY SHALL BE IMPOSED UPON THE

PRESIDENT, OWNER OR ANY RESPONSIBLE OFFICER.

(D)IF THE VIOLATOR IS AN ALIEN OR A FOREIGNER, HE SHALL

BE DEPORTED IMMEDIATELY AFTER SERVICE OF SENTENCE

WITHOUT FURTHER DEPORTATION PROCEEDINGS.

UPON FILING OF AN APPROPRIATE COMPLAINT, AND AFTER

DUE NOTICE AND HEARING, THE PROPER AUTHORITIES MAY

ALSO CAUSE THE CANCELLATION OR REVOCATION OF THE

BUSINESS PERMIT, PERMIT TO OPERATE, FRANCHISE AND

OTHER SIMILAR PRIVILEGES GRANTED TO ANY BUSINESS.

ENTITY THAT FAILS TO ABIDE BY THE PROVISIONS OF THE

LAW."

13 SEC. 12. Section 12 of Republic Act No. 9064 is hereby renumbered as Section 14 and is

14 further amended to read as follows:

16 "SEC. [12] 14. Funding. - The amount necessary for the implementation of the

17 cash incentives and retirement benefits program of this Act shall be taken from the

18 net cash income of the Philippine Amusement and Gaming Corporation

19 (PAGCOR), to be remitted directly as a special account to the National Sports

20 Development Fund (NSDF) of the PSC. This is in addition to the regular income share

21 of the PSC pursuant to Republic Act No. 6847.

23 A separate fund equivalent to not less than sixty percent (60%) of existing NSDF

24 shall be automatically set aside for the training and preparation of national athletes,

25 NATIONAL ATHLETES WITH DISABILITY OR DIFFERENTLY·ABLED

26 ATHLETES covered by this Act.

28 Not less than five percent (5%) of the NSDFshall be set aside for the

29 selection of individual athletes at the elementary and high school levels in track and

30 field, swimming, badminton, ping pong and similar individual sports events where

31 the Philippines can develop into world class competitors. Said fund shall be

32 administered by the Department of Education, Culture and Sports (DECS)."

34 SEC. 13. Implementing Rules and Regulations. - The PSC, in coordination with the

35 POC, NPC PHIL, DEPED, CHED, TESDA, DOF, BIR, and other concerned agencies shall

36 promulgate and issue the Implementing Rules and Regulations within sixty (60) days upon

37 approval of this Act.

1 SEC. 14. Congressional Oversight Committee. - A Congressional Oversight Committee

2 is hereby created to be composed of the Chairs of the Senate Committees on Amateur Sports

3 Competitiveness and the House of Representatives Committee on Youth and Sports

4 Development, and two (2) members each from of the Senate and the House of Representatives

5 who shall be designated by the Senate President and the Speaker of the House of

6 Representatives: Provided, That one (1) of the two (2) Senators and one (1) of the two (2) House

7 Members shall be nominated by the respective Minority Leaders of the Senate and the House of

8 Representatives.

10 The oversight committee is hereby mandated to oversee the implementation of this Act

11 for a period of five (5) years. For this purpose, the oversight committee shall set the guidelines

12 . and overall framework for the monitoring of the implementation of this Act and shall adopt its

13 internal rnles of procedures.

15 SEC. 15. Separability Clause. - If any provision or part of this Act, or the application

16 thereof to any person or circumstances, is held invalid or unconstitutional, the remaining

17 sections of this Act or the application of such provision or part hereof to other persons or

18 circumstance shall remain in full force and effect.

20 SEC. 16. Repealing Clause. - All laws, decrees, orders, issuances, rules and regulations

21 or parts thereof inconsistent with the provisions of this Act are hereby repealed, amended or

22 modified accordingly.

24 SEC. 17. Effectivity Clause. - This Act shall take effect after fifteen (15) days from its

25 publication in the Official Gazette or at least two (2) newspapers of general circulation in the

26 country.
